AKA GMAC Homecomings is out to get our money and our home if it takes them years. They will find a way and destroy us at the same time

We refinanced our original mortgage in May. For the first 6 months of this loan we had no problems.

In January the loan was transferred to Homecomings financial. From that point on trouble.in April of the same year an automatic debit did not go through, we did not know until notified by the bank and sent a check in by mail. We heard nothing until the beginning of June when we received foreclosure papers and our check we had sent in the mail.

We called right away and were sent to the foreclosure department where we started on repayment plans. The first plan called for us to pay $5000. The first month and $3000. The next 2 to catch up and pay their lawyer fees. Well the first month we made but were unable to come up with the next $3000. Payment. When we called they told us we should not have agreed to a payment we could not make. Each time an arrangement was made they would and still say it is they only way. Finally in February after some $34,000.in payments made through Western Union we were caught up and should have been out of foreclosure.

In the summer of 2003 we filed for bankruptcy, which was discharged in October. We have received only 2 statements since the beginning of all of this. When we have called and asked for one they said not during foreclosure and not during bankruptcy.in June of this year we were behind a month and received a packet offering to help us out. I called and spoke with a specialist who had finally sent me one of the two statements we have received. He took the payments. At this point they we were paid up and they again stopped taking our payments, cut off access to the Internet site to pay on or see our account information.

The person who was handling the account changed to the person who is now supposed to handle it and it is very hard to speak with. According to her she was to set up a modified loan with a lower interest rate for one year. Because I was unable to talk with her I went ahead and made payments through Western Union until Dec. We still have received not one piece of paper, phone call or anything that could be construed as communication. Every phone call has been made by us at one point they had us speak with a mediation company but there was no follow through on there part that we know of.

I also had a problem with them paying the homeowners insurance bill and had to go through the state program which they did not pay until it was almost to late we went almost 8 months without homeowners insurance until we got a collection letter from Allstate. I was told by Homecomings that it had been paid. Homecomings sent numerous notices that they were going to charge their insurance to our Escrow account, I kept calling and finally got it taken care of. But some of the money in our Escrow account was moved and no accounting of it has been given.

This has been a mess or nightmare from the start, we want out desperately. I have read many of the files on this site and have gone through just about everything. Our biggest problem is if we sell (after reading everything posted I doubt we could) because our credit is so destroyed, we will never be able to get another loan, and with 4 kids there is no other way. We don't know what to do. I can't keep making payments to a company that does not communicate with us at all, where is the money going? We have no idea where any of our money since June is going. We need someone to help.
