RIPOFF unposted payments result in excessive late charges

I had the misfortune of having this company purchase my second mortgage. I subsequently lost my job and as our savings dwindled I called and asked for advice. I was told there was nothing to do until the mortgage falls behind by more than thirty days. Well several payments went missed until I got back to work. The first lender had by now begun foreclosure, we got them current and I set my sights on Homecomings. They created a repayment plan which we entered into. I sent a 3000.00 initial payment and began monthly payments of 150.00 above the original P and I the plan was for 18 months. Two months into the plan we get a letter stating the plan was cancelled due to nonpayment and that the entire mortgage amount wss now due or they would foreclose. As many of you already know, Homecomings allows no grace period during these plans.in order to avoid any problem, I sent the payment by the 20th of the preceding month in which the payment was due.

After several days of absolute and total frustration involving hours on hold with this company they admitted that their computer system could not cope with the payment being posted early and that it was posting the payment to the following month. They appologized and said that everything was fine. I asked for written proof of thier error to which of course they refused. This scenario repeated for each of the following two months. After the third occurence I threatened legal action and some schmuck called me the following day to state that "we at this office now have your account and I promise this problem will not repeat" All went well until after I had made the final "penalty" payment.

Okay, fast forward to present day. I mailed the October payment on or about September 23rd. I fully expected some sort of correspondance for Homecomings as to the completion of the repayment plan, and where they would want me to send subsequent payments (the penalty payments of course are mailed to the attention of "foreclosure prevention"). When none came by the middle of October I decided to inquire of them. I logged on to my account only to discover that a couple of hundred dollars in late charges had been applied in July! This in spite of the fact that the account showed that the payment had been received!!! Five days early.

So I call em. Ms. Customer service rep tells me that they did not receive a payment in June, not July, but June. Now I'm looking at my account history as I'm talking to her and reading to her where it says that the payment for JUNE was in fact posted. She tells me, "Well we don't have any record of receiving the payment". So, I faxed the stub of the cashiers check and got a copy of the "cashed" check from the bank and faxed that. The following day I called to verify that this had settled the matter.

I was told that they had received the docs BUT "you're account has been behind for months and months, looks like it goes back to march". As calmly as I could I explained to her the astromical absurdity of her statement. Why then are late payments only in July?"I don't know" (enourmously loud and heavy sigh) so I faxed the entire 18 months worth of proof of payment, I haven't heard anything yet, going to give them until Monday. Pray for us.
