After reading only a couple other posts, I'm hoping that someone has filed a class action against Wells Fargo and the "lost" paperwork. On one hand I feel somewhat better knowing I'm not the only one they've done that too. On the other hand, I'm still not out of the woods on saving my house.

I got behind on my mortgage payments. I called Wells Fargo to see what my "options" were. I was given a "payment" plan but was not told I had to make a committment that very phone conversation or that "plan" was no longer available. When I called back to say I have the money and want to do that plan, I was told it was no longer available.

After a few calls to Customer Service I agreed on a payment plan and was told I needed to send in $5000.00 immediately and I was also told what the rest of the "payment" plan was and that I would be receiving paperwork.

It was getting close to my 2nd payment being due and I had not received the paperwork so I called and was told -"it was mailed out." I explained that I didn't get it and could they resend it. I asked if they could fax or email it to me and I was told no, but that it would go out in the mail that day.

Still no paperwork and I go ahead and sent in my payment as outlined in my phone conversation. I sent in the payment with a letter saying here is my payment and that I still have not received the paperwork. Guess what... They send my payment back to me saying I didn't have a "payment" arrangement. They also sent my letter back with the check.

I faxed a letter to the foreclosure attorney and never heard back from him. I have now received a letter from Wells Fargo saying - since I didn't adhere to my payment plan - you have to start all over again.

I have written down every conversation with them and send letters after the conversation to them. (I'm a legal assistant so I know to at least do that.) I have faxed Wells Fargo and their attorney and no one responds.

I have become very depressed as I know I messed up in getting behind but I was trying to do the right thing. Why doesn't Wells Fargo have to do the right thing? They accepted my initial payment of $5000.00 with no accounting provided by them for where it was going. About $2000 of it was applied to the mortgage.

This has been after several phone calls and written correspondence to Wells Fargo. I have everything documented and I bet they record all CSR phone calls so they should have the one where the CSR agreed to the payment plan.
