Just like thousands of other people in the US due to medical bills we were forced into filing Bankruptcy in October. Our court date was December 13. Our mortgage payments with Ameriquest were current and we had planned reaffirming our home and keeping it. As of our court date 12/13/05 Ameriquest had not sent the affirmation agreement to our attorney and would not return any calls.
At that point they had already raised our mortgage payments to over 900.00 per month. At that time we decided to add Ameriquest to our bankruptcy since we did not think they were going to reaffirm. We never heard anything else from them until February. They started sending up monthly statements for the mortgage payments! Our bankrupcty was finalized in June and they are still sending up monthly statements wanting money.
Now, here is the show stopper! WE received papers on 1/19 were Ameriquest is forclosing on the property and sueing us! They are actully foreclosing on property that was reliquished in a bankruptcy 7 months ago. Can you believe this! I have a call in to my attorney and I hope I hear something first thing Monday morning. These people must be on drugs or something. I just can not get over this crap!
