We decided to refinance our home in 2004 and in doing so we thought we were going to get 5000.00 cash back to do some home improvements. Ameriquest promised that we were going to receive the 5000.00 cash back and we were fine with all that was promised... Untill the day of closing...
On the day of closing we were getting ready to sign the papers and the closure asked us for 345.00, We did not understand. We were suppose to get 5000.00 and not pay. Well we read farther into the contract and found out that there would be no 5000.00 cash back to us that no explanation was given and that if we wanted to refinance we would have to pay 345.00 and to sign the papers. So out of desperation because we were behind on our payments we went and sign the contract.
A year after that we had to file Bankruptcy, we have been trying to get the home financed for 3 years and have found 3 people to refinance but because the payoff is wrong, 5000.00 in interest that Ameriquest says we owe after we filed Bankruptcy 13 which is against the Bankruptcy laws. We now are suing them to get the 5000.00 off so we can refinance the home through another company. This has been pure h*. We have an attorney along with the Trustee on our side fighting over this but if there are any more people out there that can help we would really appreciate it.
