Ripoff Illegal business practices in washington state

I have been getting calls from RPM apparently for some time at my parents house. I forgot to pay my last bill to Sprint PCS so they sent me to this company for collections. However the number they have been calling for me is at my parents house. My mom started complaining to me that I need to call them because they were getting 10-15 calls a week from them. So one day I was over there helping my dad with something and guess who called... Rpm. The lady on the phone was real polite and help me set up 2 payments to take care of the charges.

Payment # 1 was authorized for November 3rd (AKA Payday) It was for $131.35. So november 1st rolled around and I went to look at my bank account online and it was negative. So I looked at it and RPM had taken money out of my account that was unathorized. So I called them and they said they would listen to the tape recordings and if it was indeed unauthorized they would refund me the money and also pay for my over draft fee. They said to call back in up to 2 days to find out the status. I called every day for 3 days and keept getting the same response. "we need to listen to the tape recordings."

Payment # 2 was authorized to come out on the 5th of december (payday). But guess what. The 6th of November came around and I look at my bank account again and RPM had taken the second payment unathorized out of my bank account again. 2 unathorized payments in less than a week. I called them because naturally I was very p.O.'d. So in talking to the gal who answered the phone they had listened to the tape recordings and I didnt mention dates for the checks to come out. Wrong answer. I did indeed do that. So we went back and forth and she said something to the effect of "i just listened to the tapes and you didnt and thats final." so I said... Great can I get a copy of the tapes please? And she says... Oh they are lost now. We cant prove that you said any dates now. So again, I was pissed off I asked to talk to the manager. She said that the tapes were lost as well and assured me that I didnt set up dates with the checks. Then eventually after much arguing and multiple phone calls after they were transfering me to their supervisors (which every time turned out to be a fax machine) they said well we might be able to refund the money. I said... How long would that take... 72 hours minimum. I asked the gal, is there a way to push that through faster, can you talk to your boss. She said and I quote..."I have kids to take care of, I'm not going to risk my job asking my boss a question like that." I couldnt even believe it. Now they insist that my records are lost but are going to refund me the money. But I'm not settling there. I want them to pay my $388 debt as well as my $20 over draft fee that they charged me.

Heres the deal. I contact the better business bureau as well as my state attorney general. I found out that in washington state collection agencys are not allowed to make more than 3 phone calls to you a week. Also in washington state it is the law that if they take money out of your account more than 5 days after you talk to them they have to give you written notice within ample time. RPM has broke the law here on both accounts. My dad thinks I need to contact a lawyer.
