First, I didn't orignally sign with this mortgage company, my second lean on my house was sold to them. Let me give you a little background, I just went through a divorce and am a single mom and not living on the property, but still trying to make the payments. So needless to say they were a little late, I was receiving the forclosure letters and so forth.
Well when I would send in my payment including the late fee, the smart person receiving the payment would apply my full payment to escrow (which I didn't have with them because it was a second lean) therefore leaving me with still no payment showing in there system. This happened several times till I finally caught up on my payments and there was not an opportunity for their repeating it. So I get this cleared up and..
I receive a notice in the mail, saying my escrow has increased about $100 and so in turn my payment went up. Pretty new to whole house lingo, so I was just like dang ok taxes go up, sometimes they miscalculate insurance so on. So I excepted it and paid it.
Then one day I was speaking with a representative with ASC and they mentioned to me that my escrow had increased because I had not had proof of home owner's insurance for them so they had decided to purchase some for me, how nice. They insisted they had sent me a letter explaining why the increase had occured but I had never received the explanation just a statement with new payment. This is six months later and I realize that since I have been paying for insurance to them, I already have home owner's insurance on my first home loan included in their escrow account.
I want a refund, not be applied to my loan but to me. I first receive a check for a small amount pretty quickly, but the remainder took about 3 months to get because they kept awaiting approval to send to send the refund to me even though they had received a refund from the insurance co. Every time I would call to check on this refund there was a diffent answer to when i would receive it. What is funny during this time ASC had the nerve to call me on the second of the month when my payment was due on the first and ask me where my payment was, when they still owed my $400 and was two months behind on that.
I told them when they paid me in a reasonable time they would in turn get the payment. I still made my payment, even though they hadn't given me my check yet. This all began in November and it was Mid April before I finally received my refund.
I finally sell my house in June and am advised not to pay my june payment because it is already worked in to the closing contract on the totals, so I don't. When ASC started calling me, I told them i was in the middle of a contract on it and they would be paid off soon. But no this did not stop them. They called me everyday after that, even the day after the contract was complete and I told the representative that I know longer own the property and the loan should be paid off and she in turn warned me I would continue to receive calls everyday from them. I do not know what kind of guidelines, they are taught to follow.
During the time period I had the loan with them, after speaking with over 15 different representatives I only encountered one nice and helpful one, which I had informed her of at the time of the call.
