In August my loan was transferred from Ameriquest Mortgage to America's Loan Servicing Co. I never received a letter from ASC stating that they had my mortgage. After finanly getting my loan number to make my payments, things seemed o.K.
In February I received a letter from ASC stating that I owed $479 to my escrow account, because only half of my home owners insurance had been paid for 2005. After I contacted my insurance agent and showed proof of the entire payment their story changed.
I found that I actually owed $110 from the statement they sent me and I am still looking into that amount, because it is probably wrong. Now the story is that their company requires a $369 amount on top of my monthly escrow payment.
I have talked to several employees, including supervisors about this. I explained that when my loan was transferred, the conditions and terms of my previous mortgage agreement could not change. I was also told this from a supervisor from Ameriquest Mortgage.
The first person I spoke with agreed that I was right and that my payment would be applied to my principal. I told her I did not want my payment applied to my principal, but to apply it to next month's mortgage payment. I am a single mother and I lost my job in December. She said she would put in a request but could not guarantee it.
I called the next day and spoke with someone else that I could not understand because of her foreign accent. I asked to talk to a supervisor, but one would not be in the office until noon. I asked for the supervisor's name but she was not allowed to give it.
I called again the next day and spoke with a supervisor (supposedly) who said that each mortgage company can request a larger escrow payment even if the previous one did not. I have talked to several mortgage company's about this and they all have said the same thing. THEY CANNOT DO THIS!
After losing my job in December I fell behind in my payments by 2 months while I was also filing bankruptcy. I received letters stating that if my payments were not received by January 30 they would excellerate the foreclosure process. I did get the payments in on time and then was told that a $573 fee was added on to my loan for the foreclosure papers from thier company.
Since no foreclosure papers were filed, how could they charge me. But they were nice enough to tell me that the $573 didn't have to be paid immediately, but somewhere throughout my loan. I'm sure their charging me interest.
If their was any way possible to refinance with someone else I would, but since I am not working I have no choice but to deal with this company. IF YOU ARE THINKING ABOUT MORTGAGING YOUR HOME WITH THIS COMPANY-DONT! I have had other problems with this company, but this is what I'm dealing with now.
