My loan was sold to HOMEQ 2 years ago and that is when my trip to HELL begun. As with many of you we fell behind 1 month do to my husband being laid off. I sent them a check (overnight) on the 15th of the next month then sent it back. A letter came the next day stating they were starting foreclosure proceedings.
We call and off course they were rude and not helpful, so we filed Chapter 13 June. December we received a letter stating that we have never paid HOMEQ and they were requesting our Bankruptcy to be discharged. We gave out attorney copies of every cashed check and the overnight receipts.
The judge found that we had indeed paid all the months, however HOMEQ stated we were 15 days late (even though we had the overnight receipts to prove date sent and received) we have to know pay $2500.00 attorney fee for HOMEQ.
I kept thinking that if I keep really good records we can beat them at there own game. However after reading others post I am beginning to wonder if walking away for this nightmare is the only course of action to take.
There has to be a way to stop this company. If there is a class action lawsuit please let me know.
