Finance ripoff fee applied against credit limit salt lake city utah

I checked my credit card limit via their website and I had roughly $70 left. I went out and charged an item against my account at Walmart for $59. Later that month I discover PROVIDIAN has charged a finance fee to my account and included that fee as a part of my credit card limit resulting in my account now exceeding their set limit for me. Then, as a result PROVIDIAN charges me a $35 over-limit fee. I am not sure where the legality is at with this (I am not a lawyer) - and feel fairly sure what PROVIDIAN did was legal. However; just because they can get away with that doesn't mean it is right. I feel as if I have been tricked and robbed as a result. PROVIDIAN should be charging any finacing fees and apply them OUTSIDE a person's credit card limit so they are not misled as I have been. I feel this system that is in place at PROVIDIAN could/or has potentially misled perhaps thousands of people into thinking they are under their limit but then discovering that because the finance fee has been charged against their limit they are now over their limit and have been charged with a $35 over-the-limit fee. They fooled me once but they will not fool me again. I have closed my account as a result. I will suffer as a result I'm sure, but if everyone did what I did when they are tricked and suffer their own individual consequences as a good of us all credit card companies that operate as PROVIDIAN does would have to notice us. Their only response to my concerns thus far has been I should have known that the fee applies against my credit limit and that it is essentially my fault. If a company truly cares about their customers and this is in fact not meant to be a trick why is this type of policy in place? I fail to understand any possible reason why this fee would have to apply toward an individual's credit card limit other than trickery and making more money taking advantage of the tired and busy lifestyles of most people today. I am confident I am not the only person who has "discovered" PROVIDIAN's policy on this the hard way. I think it is poor form to take advantage of people like myself who don't have the time or energy to monitor for trickery when I thought because it was a major company there was a degree of trust I could have. I shouldn't need a lawyer for every simple minor thing in my life - this is a sad state of affairs that our society has let this go this far. Please anyone that reads this remember - there is a differnce between legality and doing what is right! Evil and treachery is done every day and much of it is legal!!
