EMC Mortgage
Fraudulant billing, Trumped up charges

When EMC first took over my mortgage account from Superior they sent a letter saying that they would comply with the law and honor the original mortgage contract. Six months later, after I paid in excess of the amount owed, I received a series of threats to foreclose on my home regardless of the fact that I had never missed a payment. After sending a series of counter threats with documentation of my payments they corrected their error although they had reported me to the credit bureau as delinquent.

Since that time I requested that they could atone for their mistreatment of me by lowering the interest rate to what was then a reasonable rate. They refused, but I continued to pay. I round up to the nearest 10 and frequently send extra payments.

Now they want an extra $100 for something they call an "Outstanding advances due from borrower." They never sent me any "advances". When my payments, due every 28 days, coincide with my car payment, I send the mortgage payment early. If there has been any "advance" it has been my payments made in advance. My original contract states that overpayment will be applied to principal. I have never missed a payment or paid late.

I check the Contact EMC web page each week at https://www.emcmortgageservicing.com/ccn/contact.Asp to verify that my payment was received and called them to inquire what this advance charge was for. They transferred me from one person to another who did not answer in 30 minutes. I had no further time to waste on this organization of thieves but received a letter from them saying they were looking into my inquiry and would send me an answer when they made one up. (OK, that's my interpretation.) Meanwhile, I sent the extra $100 in a seperate check so I will have evidence. I live with the hope that these people will clean up their act, but it seems unlikely that they will.

To add insult to injury, every piece of corespondence from them carries the line, "This is an attempt to collect a debt; any information gained will be used for that purpose." As if! Any honest lending institution would be thanking me for my consistent timely payments. This company is truly evil, and I advise anyone who can do so to remortgage or pay off before they destroy your credit rating by making fraudulant reports about you guised as errors. They need to be put out of business by any means necessary.
