Ripoff Potential Forclosure, Refused Payments

Ditech has refused agreeded upon payments for my Equity loan, they contacted me at home and suggested I pay 200.00 on a 1 month past due equity loan payment. So, when I gave them a date I could pay, the lady on the phone accepted, when the date came, they refused.

Here we are 4 months into refusal of payments, and Jennifer at Loss Mitigation says she'll keep my home out of foreclosure and work with me, provided I fill out thier financial worksheet. Did that, then she calls to tell me thast she can't help me because I have more money going to bills than coming in, naturally, otherwise I wouldn't have been late.

SO, I received paperwork from her listing my options, one being Deed in Lieu of Foreclosure, so, being that I plan to move home with my elderly mom, this seemed a better way for everyone involved.

I call Jennifer and ask her about DIL, she claims that GMAC doesn't accept it anymore and the papers she sent me, dated 6/21/05 were computer generated and it was a mistake. I faxed her back a copy of the letter with my own letter saying how they refused a payment and I didn't feel they were justified to refuse when they set up the payment agreement in the first place.

Meanwhile, I have been sent a letter from an Atty in MI that says I have until July 29th, which is less than two weeks away. I have began packing and moving my things the mom's.

I tried to consult a bankruptcy atty, but cannot file because my name is on the deed to my mom's paid-off house along with her name. Bankruptcy will take her home, and she will be homeless as well. However, I cannot stand by and let a sherriff lock my home with my deceased father's military Silver Star's and the flag that drapped his casket, no way.

I would love nothing more than to simply return the home and face the bad credit, yet they are saying they no longer allow that.

I've had the home listed with Prudential Real Estate since Dec. well before I missed the 1st payment. My 1st mortgage is current, yet I do not trust a word Loss Mitigation is telling me, I'm moving out regardless.
