GMAC Mortgage - Ditech Absolutely NO Help from GMAC Mortgage - They're always right, you're always wrong, Waterloo

In mid Jan. Of 2008 I received a letter from Ditech stating that I was 2 months in default with my mortgage payment (that was true) and that my home would be going into foreclosure. Like so many others across our great nation, I too had fallen on some bad times financially.

Ditech had turned my account over to the Law Office of David J. Stearns for collections. Upon agreement with Gmac - Ditech. I was able to stop foreclosure proceedings.

The Stipulation Agreement: Total Due To Bank (GMAC) $5,102.60 Attorneys Fees and Cost $2,650.00
Totla Amount Due $7,752.60

Upon execution of this agreement, I was to pay the initial payment of $3,876.30 (I paid this) with bank money orders (I have all my reciepts) made out to GMAC Home Mortgage 500 Enterprise Rd., Siute 150, Horsham, Pa 19044-3503.

The balance of the arrearage in the amount of $4,001.30 will be paid over 12 months. EAch payment will be $3234.03. This was added on to my monthly mortgage payment. I also have all my reciepts which I paid with certified cashiere checks.

I have made all my payments on time and through the rest of the year I never once heard from GMAC-Ditech concerning my payments.

In mid Dec I received a letter from GMAC stating that my acoount had been sold (of course they didn't use the word "sold" but, that's what they all do) to Nationstar.

First part of Jan. 2009 I called the Law Office of David J. Stearns to see if I could find out why this was being done since I was still in a stipulation agreement with GMAC.

NO HELP there! These people in this so called lawyers office were down right RUDE! They told me that my case with them had been CLOSED since Oct. 2008. WHAT? Oh! I see, says the blind man. They got all their money by Oct., so they were out of the picture as far as they're concerned.

Wanting a smooth transition, I called Nationstar to find out what my payments would be with them starting in Jan. 2009. The rep at Nationstar told me to send in my regular payment (which I did).

Since then, I have received 2 letters from Nationstars legal dept. Stating that I was in default. WHAT!!!

Called Nationstar again, told them about the letters and their rep told me to just throw them in the trash. I did just that!

Received my Feb statement from Nationstar stating amount due for 2 mos. WHAT!

Called them again, asked why I owed 2 mos. Was told they did not receive my Dec. 2008 payment from GMAC - Ditech. I told them, I made my Dec. 2008 payment to GMAC-Ditech. They told me that I would have too call GMAC and have them send Nationstar the Dec payment. I had too make the call. Not them. ME!

So, I made the call to GMAC-Ditech and after 30 mins on hold I finally got hold of someone to talk with. That did absolutely no good whatsoever.
Put on hold again. You know the story!

I talked to 7 different GMAC-Ditech reps in a 3 1/2 hr span. HELL-O!

I was told that my Dec payment was applied to Nov. WHAT! WHY? Was told I was behind on my payments. How could I be when I was in a stipulation agreement? I made all my payments on time. I have everyone of my receipts. They DID NOT care! On top of all that they have charged me $412.38 for late fees. WHAT! What! I never received a notice or any kind of communication of me being late. And Nationstar says they will not wave the late fees. Isn't that nice!

Where do I go from here? Who do I turn to? Is there any help out there?
