In 99 i purchased a truck and was financed with what is now Drive Financial in Dallas.By the end of the year, my attorney in a move to avoid my wages garnished if granted by the court, on a mortgage/homeimprovment ripoff case, suggested that I file chapter 13 which I did, but this was the beginning of my nightmare with Drive Financial, the court decided that due to the fact at hand he was not awarding attorney fee's to be paid by me, anyway, I filed chapter 13 for nothing.
I wired my payments to Drive, and it seems that every other month my insurance was being used against me as not having insurance when I actually did. My chapter 13 was discharged and I received a letter and then a year later, when I attempted to make my last payment by WUWire and I had not gotten my title, I decided to write and request my title, little did I know that my last payment had yet to be acceped but instead was denied by Drive Financial.
They were seeking what the court did not grant them in interest. And I found again, that I had to seek the bankruptcy courts help. They then sought the original amount of the loan $36,000 with interest and belive me that they never provided me with any proof of claim information for me to complete my forms, and in the end without the forms my case was discharged in July.
The truck needed a new motor and the transmission was going to need work also, so being that I was living at my deer lease, I took the truck and borrowed some tools and generator equipment. When the motor was picked up I had it loaded onto the back of the truck in the crate, and being that it was between Thanksgiving and Christmas, I did not go due to the rain and floods we had that year so I could not drive back to the deer lease.
In Janaury I went to the deer lease, and was surprised to find that the truck was gone along with everything, in it including my guns and all the mechanical equipment I had borrowed. The only thing left was the transmission I was working on. I knew by my exwife that drive financial had been calling her and her neighbors and talking bad about me, and even placing me inside a neighbors house making phone calls to Drive Financial to a point that I went into the police department and told them that they could check the neighbors bills and see that I never made any calls to that number.
I never received any letters or calls at work from Drive in all this time. I called the County Sheriff and I was told that usually when a repossession is between counties or in isolated areas the repossession was not called in. But as I was leaving the lady accross the street stated that a red repossession tow truck grabed some tool from behind the truck and broke the lock on the livestock gate and the man backed up to the truck and threw items on the back of the truck and left without closing the gate, and that the hood flew off the front, and landed on the side of the road. The owner of the land had cattle inside the 400 acre tract of land and the cattle got out and were put back in by the police when a car hit a cow.
A year later, I receive a letter that Drive had filed a Writ to sequestor the repossessed truck and I sought the bankruptcy court help since I felt that I did owe for the transmission and little parts. But the case was dismiss becasue I did not have hte secured truck, and Drive filed again a proof of claim for $38,000.00 and I did not even have the truck. My girlfriend did purchase the tag as a mistake but I havae the tag somewhere in my work room. And now after months and years, the repo men still bother the mother of my kids. They go through the woods and broke into the garage, which is too small to hold a one ton truck. Used crow bars to open the wide garage door breaking the brackes off line, and the door seal was tore up.
Before doing this, my daughters blue heeler dog was hit with a hard object on the head, and she states that he was hit becasue the head had blood and skin was tore. She had had this dog since 1982 she was one year old. Now, again, they are bothering my daughter by threateaning to take her 2003 Mustang GT that is in my name due to insurancae, on a differant policy, but she paid for this car cash from an insurance settlement when she was hit and both of her knees were smashed. The mother of my kids and the grandmother are being snubbed by the neighbors no telling what the repo man told the next door lady and today, when I learned of this insident when my son came to wait for me after work, I learned that my daughter was terrified to go back to school she is scared and wants me to transfer the car into her uncles name.
I am still being harrased by Drive after being cheated payments they received, they have gone befoare the court and flat lied. When I had proof but the mistake I made was that I was pro se. I defended myself. I stood no chance against a company with high paid attorneys nor did I call the judge by his first name. Everything I now own is in my wifes name. This afternoon I called the man who left a card with my wife at her requested and this man was rude, and stated that I was a liar, and was very rude. I do not have this truck. According my my kids and exwife about 10 differant repo companies have come to their house seeking a truck that another repo company had already gained. I only know that it was a red truck with a 281 area code. Had I not requested my title in August when the last payment was made, things might of been differant, but I elected to be honest and seek my title when my records showed that I had paid what the court had granted to Drive Financial as per the federal laws. THis is, how my personal opinion of Drive Financial is, they are legally liars and crooks.
