Ripoff failure to take payments and accept proof of insurance while continuing to charge legal fees forced insurance and other fees while foreclosing

Due to ongoing, and I suspect illegal practices, difficulties I have been recently experiencing with Homecomings and now Litton, I decided to research online consumer complaints. I thought my case was unique: check by phone payments delayed, late fees assesed for Homecomings continued failure to accept electronic payments, forced insurance when current policies exist and proof has been submitted, Homecomings irresponsible practice of floating checks to ensure foreclosure, etc. Is not unique to me.

My current situation:

As of Nov. I became deliquent by 2 payments.in Nov. I received foreclosure papers from Homecomings. The foreclosure record was said to have been filed on Nov. 22. Later, I received a letter from Homecomings stating that my loan was being sold to Litton Loan Servicing, LP on Jan. 01. On and after Jan. 01 the letter instructed me to contact Litton to get the new loan number and to make payments to Litton on or after Jan. 01.

By Dec. 28, I received no letter from Litton.

On Dec. 28 I called Homecomings and was transfered to MaNeisha LaFate. I called to inquire about the status of my account in an effort to pay the total sum to bring my loan current. When I asked about the total sum of the reinstatement costs, MaNeisha initially refused to provide the information. As she stated, what difference would it make, I wasn't going to pay to make the loan current. Several times I repeated that I could pay and would pay, but I didn't know the exact figure owed. I needed to know the exact amount to determine if I could pay the entire sum before Jan. 01.

Finally, I was able to get MaNeisha to fax reinstatement figures. The Figures showed the amount due as of Dec. 28 and the amount due as of Dec. 31. The figure for both dates was $6,522.18. I was told the only acceptable payment methods would be a cashier's check or western union.

The total sum exceeded my daily limit of withdrawl from my ATM/DEBIT card, so I purchased a $6,522.18 cashier's check at my bank approx. 30 minutes after recieving the faxed resintatement figures. Then, the letter was sent overnight express with UPS.

MaNeisha asked I call her with the tracking number. On Dec. 28, I faxed the documentation: copy of the cashiers check (made out to Homecomings Financial - Loan number) and a copy of the Delivery receipt.

As of Feb, 09, I have been informed by Litton that I either did not send the cashier's check, I mailed the check to the wrong address, or the check was lost.

According to Luis Quintero at Litton, Homecomings Financial shares a building with 2 different companies and my delivery, if I mailed the check, must have gone to one of the other companies.

Per the instructions of the fax, the check was mailed to the address given by MaNeisha at Homecomings:

Initally, when I called to speak to Luis, he informed me I never made a payment and refused to speak with me. I gave him a tracking number and a delivery date. Luis did verify the tracking number. Once he verified the number, then he asked me to fax my documentation of payment, method of payment, and delivery service. I sent additional documention. Two days later, Luis tells me I sent the payment to the wrong address. As I was told on Feb. 09 by Luis, if I did not make payment before my foreclousre date, and days earlier than the complete 90 days, my house would be forecloused.

Over the past week and a half of faxing documentation: cashiers check, mail receipt, reinstatement figures from Homecomings, etc. I was told by Luis that none of my documentation was valid to show payment was made and the documentation would not be sufficient to use in court to show I made an attempt to pay the loan and bring it current.

On Feb. 09 I was instructed by Luis to go to my bank and have a new cashier's check reissued. When I attempted to ask Luis about unforseen problems outside of my control with regard to the reissuance of the cashier's check, and the consequences, Luis refused to discuss the consequences or process. Again, I was simply told that if payment was not made within 6 days, less than the 90 days, my house would be foreclosed.

Unfortunately, when immediately going to the bank after my last phone call with Luis, I discovered State Law prohibits me from following through with reissuing a check in my required time frame. The law stipulates that a cashier's check cannot be reissued for a period of 60 or 90 days. The Banker has called Luis Quintero, and Luis' superiors. He left messages with all 3 asking that all or anyone return his messages.

My banker has been gracious to help me in this matter by offering to send documentation from the Bank that the cashier's check was issued, since Luis claims my documentation was insufficient.
