I refinanced a property in wisconsin with Ameriquest. My motehr was also on the loan. She was unable top work for 6 months and our payments went behind.
After a barrage of calls I faxed them not to call any more. On December 20 I called Customer service and asked how I could resolve the arrears. I owed for November and December at that time. The December payment was not 30 days late until The end of the month. The women in Customer service specifically told me I would not be able to make one payment at that time. I told her I was interested in talking to someone to work this out. She told me clearly that they were not interested in foreclosing and I was a good customer and had always made my payments on time. She told me I had to wait until the loan was 90 days in arrears and then it would go to their home retention division and we would work out a solution to this. She gave me her extension and told me to call her back on the 30th of January.
I attempted to call her back and the call was put into their foreclosure department. I was then informed that I was in foreclosure and the documents were just filled yet. They were filled on the 31st of january. I had been working with another lender to resolve this problem so he told me not to go over ninety days and not go into foreclosure. I assured him that would not happen because the nice folks at Ameriquest would work it out with me.
Ameriquest knows my appraised value is three times their mortgage amount. They have no focus to help this situation.in fact the interesting part of this is I am going to send the tape recordings to our department of liscensing in Wisconsin and the attorney general. Many do not know it but taping calls is allowable under title 18 of the federal code. It is ferderal law. Unless your state forbids it. Most don't care taping your calls are legal and admissable in a court case. Always tape them they tape you all the time.
They truly pathological liars. They should be sued until they are not suable anymore.
