NCO Behavior Regarding Credit Card Fraud abrasive, harrassing, disrespectful, lying employees who refuse to believe callers. Where are our government authorities to stop this fraudulent behavior!

During the summer of I received a call from a collection agency based in OK for a Capital One credit card that was defaulted on payments for a couple thousand dollars. Having never heard of this account and knowing I didn't open it, I was fortuante to have this nice lady give me all sorts of information. She told me the account number, date it was opened, beginning balance, ending balance, payments that were made, bank account numbers that the last payment came from, address on the account, etc... Anyways, it turns out this is a fraudaulant account. Someone used my SSN, DOB, and address to open the account, ran up the balance and then made one payment and stopped paying on it. One month after the account was opened under my current address, a change of address was filed to some other location in my city that I had never heard of. I even called the bank the last payment was made from and got a teller to confirm the account number that made the last payment was not in my name. So I called the police and filed a report formally.

In November, a new company called me about this account... NCO Financial. The first person who called was insulting and rude. When I explained the account was fraudaulant, he refused to believe me and said he didn't understand why I wouldn't own up to the account and just pay on it. For half an hour, I argued with this guy, told him the account was reported to the police, told him the police report number and he refused to believe me. I wound up telling him to go to hell and never call me again and hung up on him.

Later that week, another rep from the company called me about it. Luckily, this person (Peter) was extremely nice and helpful. He noted the account as being a fraudaulant account, put the police report number on the account and marked it to not be called again until it's resolved.

Later that day, someone else from their company called me and again, being fortunate, it was a very nice lady. I explained the situation again. She looked up the information and saw it was noted not to call and had the police report number on the file and apologized for calling.

A few weeks have gone by and I haven't heard from them since until this weekend.

This weekend, I received another call from the original caller about this account. Whenever this company calls me, I get a recording saying there is an important business matter that needs to be discussed with (states my name). Then it asks me to press 1 to confirm I am that person. So I get this call doing exactly that and I press 1 so I can explain yet again about the fraudaulant nature of the account.

The guy comes on the phone and says "How will you be paying for this account?" So I said "What account are you talking about?" and he says "The Capital One account." So I start explaining about the fraud again, even tho I have recognized the guy's voice as being the same guy who called me originally and was harassing. I told him I have called in previously with the police report number and it's noted in the account and should not be called upon again. So he looks it up and then comes back and says there's nothing noted with the police report number. So I start up my computer so I can pull up the number and give it to him. He starts telling me that he's looking at my credit report and that I need to accept responsibility for the account and make payments on it. So I ask for his name because he's starting to be an asshole again and he refuses to tell me. So I tell him to give me his company name and he refuses. I tell him that I know that by law I have the right to ask for his company name and his own name and he has to tell me and he says he won't tell me and then says in a really snotty and sarcastic tone "I'm from the marriage bureau and we're trying to get you married" (go figure what that is suppose to mean)... Then he starts telling me my social security number and DOB and wants me to confirm it. I tell him I'm not confirming anything to someone who won't tell me what company he's with or his own name. So he says "I already know your name, address, DOB and SSN... Why wouldn't this be a legit call?" and I respond, "How the hell do I know you're not the person who opened this account fraudualantly?" Anyways, I wound getting so pissed off I told him to f* off and never call me again and hung up on him.

Not even 15 minutes later, another person with NCO calls me and I told him that I had just gotten a call from a rude and abrasive employee about this account. I asked him if he could see any notes on the account with the guys name and of course, he didn't write anything down about the call. So I asked for a supervisor and explained the whole call in detail. She verified the police report number was on the file and was putting it back into a status to not be called and advised me to call Capital One and notify them of the police report number so they would pull the account away from NCO Financial and then it wouldn't be an issue again.

After that call, not even 10 minutes later, I get a third call from this company. I explain again.

I come into work yesterday morning and there's a message in my voice mail from them.

Most of the people I've spoken with have been nice to deal with. But this one guy who keeps calling me and refuses to tell me anything but just harasses me is getting on my nerves big time. Fortunately, I work in telecom and have a phone system in my house with a voice mail system that allows me to record phone calls (I live in a one-party state) so I have recorded every phone call this guy has made to me and kept it in my voice mail for future use, if needed.

I'm glad I found this website with so much information about how to protect our rights. I plan on checking out the sites listed because this has got to stop. I have never defaulted on a bill and have made payments on all my student loans and credit cards, but this is the second time someone has opened a credit card account in my name and I've had to fight the charges after they went to collections. Thanks to everyone on here who has posted valuable information regarding consumer rights regarding debt collection.
