Vanderbilt did the same thing to us. I had been sending the checks with the wrong account number on them and they started foreclosure proceedings on our home. I was served 10 hours before I was suppose to be there.

I showed up to Court and gave the Judge the supporting documentation. I was 1 house payment behind. I agreed to make the payment up. The following 3 months, I double my house payments so that I didn't get behind in the future. On the fourth month, they called me at work and told me the last 4 checks had bounced. After calling my bank, I discovered that not only did the checks NOT bounce, the checks cleared the first time through. After faxing the fronts and backs of the cleared checks to Vanderbilt, the "customer service jerk" I spoke with actually said "Well ma'am, if we're cashing the checks, where is the money going?"

After I told him that the money needed to be applied to my account he told me that "I better listed and I better listen good" and told me that I had no business being so angry about $3500 worth of lost payments and that if I didn't take a nicer tone, he would have our house foreclosed upon again.

After that, I mailed a check for $550; our housepayment is only $437. They mailed it backed certified to my husband only and told him that foreclosure proceedings had again begun. We were scheduled to go to Court on a Monday. On the previous Friday, at 7:30 P.M., 2 men (one from the sheriff's office and one from Vanderbilt) showed up to seize my home. They had guns drawn when they came to the door and everything.

After getting my attorney on the phone and forcing the sheriff to speak to him, I showed the guy from Vanderbilt all of my Western Union receipts and cancelled checks proving my payments and all he could do was shake his head and say "I'm sorry then ma'am, I don't understand what's going on." He was under the impression that a payment hadn't been made in 9 months.

In Court on Monday, the Plaintiff (Vanderbilt) showed up 2 hours late. After showing the Judge all of my supporting documentation, he told the attorney for Vanderbilt that they "definitely have very questionable accounting practices and an audit needs to be made of this account." Of course, it was never done - no matter how many times I called.

Now, after 2 1/2 years, I'm trying to refinance and of course guess what's holding it up? Vanderbilt has not reported to any credit bureau in over 2 YEARS. Of course I can't get through to anyone there. All I ever get is voicemail without a return response. Vanderbilt got our mortgage by buying it from someone else. I'm only going to take so much more, then I'll file bankruptcy and let them have the damn thing back.
