Initial ComplaintThe dog has a congenital defect that was diagnosed and needs to have surgery. The breeder refuses to honor the warranty of a full refund for the defectAfter taking the dog to the vet on Tuesday July 27 it was determined that her hind leg has a Medial Luxating Patella. This is not from an injury. This is a congenital defect that needs surgery to fix and on Tuesday August 3 the dog (*) goes to an Orthopedic Surgeon for her pre-op consultation. This is a very serious surgery, which is why my veterinarian will not perform it. I wasn't asking the breeder for anything other than what her warranty said (first sentences at the top of her website) regarding any congenital defect which is a total refund for the dog. This is going to be a very costly surgery and recovery and per her warranty all I was asking for was the $1,400.00 I had paid for Lacey. I tried to email her regarding this and she has now turned it around to scaring me with legal action if I do not back off. I am only trying to get what was promised to me to help with the very costly bills to come and she refuses to honor her warranty. I only bought from her because of this warranty figuring that I was going to be getting a dog that was without any congenital defects. I would be happy to send you the email correspondence that occured in trying to resolve this issue. I was upset enough about our Lacey (only 10 months old) having to go through this, but now I am upset that this breeder will not honor her warranty and is trying to scare me away. I appreciate any help you can give to get this resolved and hopefully put the word out on the unethical way this breeder conducts her business.

Resolution SoughtInitially I was only concerned with her honoring her warranty and getting my $1,400.00 back. Now I am so upset that I would like to accept any compensation for pain and suffering, as well as the medical bills from this congenital defect. Keep in mind that I have a 9 year old daughter who is equally if not more upset about all of this. I appreciate your help in resolving this matter so she cannot do this to any other family.

After I wrote and mailed the letter to you today I realized that I should have asked you to kindly go to our very informative website, and to view our 1 year guarantee that has not changed in 6 1/2 years... If you will note in the guarantee, it plainly states that any of our puppies within the 1 year range would happen to have any genetic health issues that would "cause" the dog to "have to be put down" we would gladly replace that puppy with one of their choice or cost... But again, we simply can't be held accountable for every person that has had a puppy for 9 months, and all of a sudden they are crying bad breeders... It's simply not even common sense... A luxating patella issue doesn't wait for months to give trouble... It simply doesn't happen overnight as this one did... It is a problem that is there from at least 8 to 10 weeks of age... It is very detectible at that age... That is why a great breeder as ourselves has all puppies checked at that age... We would even like to encourage you to speak with the only vet that we have used since we have been breeding this wonderful breed... Sometimes in life you will find people that are always looking for someone to replace anything as long as it comes out of someone elses pocket... As she spoke of a very young daughter that is the actual care taker of these dogs, we have no idea if she may have accidently hurt this puppy of maybe a playmate... There are numerous reasons how this could have happened, as our vet told us... We all knew that we sent them a wonderful, healthy, beaitiful puppy... Actually 2 of them... The way they are slandering us over this, we are waiting for them to tell us they no longer want the other puppy... They both got A vet checks... Please take time to read just some of our REVIEWS on Puppy Find and you can plainly read that we have numerous happy buyers... We are at the point now that we have sent pasy buyers another one in the last few months... If we are a puppy mill as she called us, we would have been exploited and out of business years ago... As for now, we wouldn't change any issues with the wonderful dogs that we breed... We hope you can certainly put 2 and 2 together to understand that they are upset with what they have evidently let happen to this poor puppy, and they need someone to blame... Additional Information from ConsumerWent to the * today to see * for the consultation and he not only confirmed that * Medial Luxating Patella was indeed a congenital defect, but saw that * has it in BOTH of her hind legs, so now she has to have surgery on both legs! The Dr is willing to supply (as well as my regular Vet at *) any paperwork to show that this was and is a congenital defect and NOT from any injury. * goes in for surgery tomorrow (Aug. 4rth) morning and then has to spend the night, as this is a very serious surgery, and then I will be getting to pick her up on Thursday to begin the very long and painful recovery. I am thoroughly upset that with all of this going on, I have to worry about an unethical breeder who is not honoring her warranty and even worse, is not accepting what she is "selling" to other innocent and caring families. This is all very heartbreaking and I hope that you will be able to help atleast stop future pain like this for trusting families like ours.
