Sent My Item to Someone Else and Refused to Refund My Payment

I ordered a Gazillion bubble maker from overstock.com and received another toy instead When I researched the delivery on ups.com, I found that my toy had been sent to someone else, and her toy was sent to me. I contacted overstock via live chat and gave them all the information, including the shipping information from packing slip for the other buyer that was in my package. Overstock promised to send me my item right away. About a week later, UPS notified me that my item had been delivered, but I did not receive it. Overstock had again delivered my item to the same wrong person/address.

I than called Overstock and asked to cancel the sale. They informed me that they would not refund my payment until the item someone else received was returned to them, as if I had any control over that! It took 15 minutes on the phone, and threatening to file complaints with the Better Business Bureau and other agencies, to get my refund. I was told this was an "exception" to Overstock's policies. Amazing - they were going to keep my money for an item I never received and they twice sent to someone else!
