I have a cingular account with three lines. I took all three phones into the store in June because reception was lousy and dropped calls were a daily occurrence. The representative told me she could swap them out for me and hopefully that would solve my problem. She did and I left the store with three reconditioned phones. We continued to have the same problems.
My July bill came with an additional $79.99 taxes charge. The explanation was "Beyond economic repair". I immediately called customer service and was told that I would have to go back to the same store that I went to in June. I did and was told that one of the phones I switched out in June was beyond economic repair and could not be reconditioned so I was charged for that phone.
I asked why no one told me there was a possibility that I could be charged and the representative told me that I signed a form acknowledging this very possibility. I did not sign any forms and was not told about it.
Approximately 15 minutes later, the representative returned with a copy of the above mentioned form with a signature that was not mine. My first name was not even spelled correctly. I pulled out my driver license to dispute the signature but she wouldn't budge. I asked to see the manager.
He was even more rude than the representative and refused to compare signatures. He said that was my signature and the charge would remain. I asked for the district manager's number.
After playing phone tag for a few weeks with the district managaer, we finally made contact. He said he had no way of knowing whether it was my signature or not and the best he could do was offer me a $50 credit as a compromise.
I refused and told him we would settle the matter in small claims court. On my August bill, I had a credit for the full amount. However, there is still the matter of the forgery which is a criminal offense.
I filed a complaint with the police department. However, the district attorney would not take the case because I could not prove which of the employees forged my name.
