I am a homeowner in a gated community where Fall Creek security was hired without the homeowoners knowledge, which is a whole other complaint, lol, to provide a service of protection and security to our community. I have lived here for 5 years and own my home outright with no money owed. I always paid my dues a year in advance until I was placed on disability due to injuries from an accident with an 18 wheeler where I lost the ability to walk for two years and have extensive damage to my leg. I try to live off of 800.00 a month which is very difficult. As a result I have fallen behind on my dues. I realize this is my responsibilty and I must rectify this in order to have my good standing and guest list reinstated. I have no problem with that. That is my responsibility. My problem is the officers have not been consistant with the "punishment" for this which is when I have a guest come in the community I must meet them at the gate. I have done that with no complaints as this is part of the rules here. Some of the guards at times have chosen to let my guests in as a nice gesture without making them pull to the side and me meet them. As a result I was mailed a ticket for 150.00 because Tad Taylor and Mr. Hearnes do not share the same compassion. I cannot complain if this is told to my guest and I have to meet him but it was not and he came in. I went before the grievance which is the next step and explained that the reason this happened was not blatant disregard for the rules but amisunderstanding because some of the guards try to be nice. They said they would take this into consideration and contact me about the ticket. Mr. Hearne was not there the night the young man came in the gate but there to testify as to what happened. When I explained to him that was not true he became angry and asked me if I was calling him a liar? There were two stories told about what happened that night. One by Tad Taylor who was not there, and one by the guard who was not at the meeting. Of course I recieved a letter that I would have to pay the ticket. The same day I recieved the letter, the guard let the same young man come in the gate again. I appreciate his kindness but in my defense I called Hearne to let him know this is what was causing the confusion and I did not want another ticket. He became angry on the phone and asked if I was complaining because his employee did me a favor and let him in. I told him certainly not. I want you to understand this is why I recieved the first ticket and I dont want another.
Now the second part of this is this young man has been coming to my house every Tuesday or Wednesday night for years as he and my husband play music together in an acoustic band.in the five years they have done this we have never had a complaint, ticket or any problem with anyone. We went to our neighbors years ago and discussed it with them and all were fine with the practice as it is not that loud. It is an acoustic band, not electric guitars. This night that I called Mr. Hearne and pointed our the incompetence at the gate, after we hung up security drives by my house. Four days later I recieve a ticket for 100.00 for loud noise. I approached Tad Taylor at the guard shack and asked him if he wrote the ticket. He replied yes. I asked if someone had complained? He replied no, they dont have to. We can write tickets at our discretion. At that time Mr. Hearne came around the corner and said we dont have to talk to her close the door. I became angry I must admit at this comment as if he was saying what I have to say does not matter. I then said to him they have forgotten they work for us the homeowner. They are to provide security and safety not to harass us. I told him I had heard from other security companies that this is a problem with them. They want to battle the community instead of working with us and getting along. I am wondering if they have a quota of tickets they must write and I have become an easy target for him. This company came here in a bad way. Our community board fired all of our security officers and gave them a week severance pay and two days notice before christmas without a vote. Some of them had been here 15 years. A lot of people were angry and not very nice to the new security. We did not participate in that at all. We introduced ourselves to them and welcomed them here as we felt it was not there fault what our board had done. Some of them are very nice. Most are.in fact many of them will say Hello Ms. Newman how are you today? Hope you have a nice day. Never once has Tad Taylor nor Hearnes been pleasant in any way. Tad Taylor wont even look people in the eye when you drive up. Never says hello. He says, Name, Address? Never anything nice. I feel like because I made that call that night to prove the inconsistency at the gate and why there was confusion about the ticket, he became angry and has now decided to write me a ticket for anything he can. I want to know if there is an organization to protect associations from unfair activity with the board members, and security? I did not want to retain a lawyer and battle the place I live but it appears I may have to. If anyone knows anything or can help I would greatly appreciate any knowledge you can share. I know that the truth will prevail. My father always told me this and he was right. If you are considering this security company, you want to consider how you want your homeowners to be treated. They do vote the board members, who in turn hire the security company. I would think you would try and treat them with respect. They could eventually determine youe fate. Ed Hearnes is not a very niceman, nor Tad Taylor, I can only assume it must stem from their own unhappiness.
