I have been disputing a termination charge from Cingular Wireless through the Better Business Bureau and the Attorney General's Office, both of which told me to contact a lawyer. My now ex-husband and I contacted Cingular on several occasions about changing my ex-husband's cell phone from my name (and financial responsibility) to his. They initially told me to fax in a copy of the divorce decree, which I did.

After a few months with no change, I called them and was told that that was not the policy, and that I had to fill out a form they would mail. I never received the form and I called again, and they sent it again.in the meantime my phone broke and I had to send it away for a month for servicing. The customer service representative told me that I would have to pay the service charge even though I had no phone, and if I lowered my service plan, I would lose the rollover minutes I had accumulated.

I still had not received the name change form, so I cancelled both phones a month before the contract expired. I was charged an early termination fee for my ex-husband's phone, which should have been in his name 6 months prior and should not have been my problem. I contacted the company and received no response, so I contacted the Better Business Bureau. After they received no response, I contacted the Attorney General. I finally received responses through both the BBB and the AG.

In those responses, Cingular lied about sending me the name change forms. They say they sent them on several occasions, but I only ever received the one, which was 6 months after my initial request, and I only requested forms twice. They also say in one letter that they told me to go to a dealer when my phone needed servicing to get a loaner phone.

In another letter they say that they have no record of my complaining that my phone needed servicing and that it was my responsibility to know to go to the dealer. Cingular manufactured and altered records to absolve itself of any responsibility in this dispute. They have sent me to collections and have ruined my credit.
