LIED and sold me a phone that wasn't new, and my service never works!

I bought an HTC Eris from a Cricket store in Hillsboro, OR in November and the guy working there lied to me. I paid $250.00 for a phone that I was told was brand new! I didn't recieve a box or the actuall charger that goes with it. He gave me a generic charger and told me the reasoning behind it, was because it was a display. The man also did not tell me that I could have problems with it working on the Cricket Network because of it being a flashed phone. I had non stop problems with it not working like it was supposed to! I went back several times, he "reflashed" my phone a few times in the store and I had it done at another 2 cricket locations. Still to no avail it didn't work. I even tried exchanging it and apparently that was out of the question.
I am currently driving east as I am moving, and I had to back track to Springfield, OR from Roseburg, OR because my phone just up and quit working. I went into a corporate store and wound up being there for more than 4 hours with them trying to get ahold of the guy who owns this store to get the correct code to unlock my phone so that they may try to flash it properly. When that didn't work a corporate lady was nice enough to give me a phone that they were sending back for my trip. It has been working great up untill I hit around Williams, AZ. I can call out, I can recieve calls/texts, but cannot send texts out. I spent two hours on the phone with customer service and got no where! I went in circles as these idiots kept trying to have me re-program my phone, but we can't do that since I am in a roaming area. Then they tried telling me that because Im in a roaming area it wont work. Um... Excuse me? Then why can I recieve texts? It all runs off the SAME network! I am so mad! I want a refund and the customer service lady is telling me that I can't have once because their company doesnt give refunds.By law I should get one since I am not getting the service I paid for! This is Rediculous! Don't EVER EVER use them! Its so not worth the headache! The amount of stress I go through compaired to the price is not worth it. They don't even have people that speak english well. I swear when you call their customer service, you are talking to someone in a different country. I even said that and didn't get a reply back. Also I have tried repeatedly to complain through their online forms and never get anything resolved. This is a horrible company! I am just hoping that I don't lose service completely before I make it to a different cell company! I will never recommend this company to anyone!
