Ripoff I still have not had the computer replaced, both UPS and Staples are saying it's the other's fault and ignoring me

The basics: In November I ordered a computer from a company I have dealt with for many years in Florida. I got a great deal, basically wholesale price as he was closing the business down and incorporating it as a new company.

The computer was taken to the local Staples and shipped UPS from there with insurance. The computer arrived damaged. It showed serious mishandling in shipping. I contacted UPS about making an insurance claim, filed the report on the phone and waited for an inspector to come out. While waiting I read up on the process and found out that the UPS pamphlet on insurance claims stated that a decision would be made within 2 weeks from the date the damaged item was inspected.

I contacted both UPS and Staples and informed them that I expected a decision before January 1 (well within their two weeks from inspection) so that the company I purchased the computer through could process the damage claim through their insurance if need be. I was assured by both that I would be notified well before Januray 1.

The computer arrived and insurance claim happened at the end of November. A week later the computer was inspected and I was notified in mid to late January that UPS felt that the item was packed in a manner that did not meet UPS packaging standards.

When the computer was accepted at the Staples shipping counter it was in the original manufacturers box and met their packaging requirements for electronic equipment.

Per UPS Staples was the "shipper of record" since Staples ships all packages accepted for UPS on the Staples UPS account.

Several months later I still have not had the computer replaced, both UPS and Staples are saying it's the other's fault and ignoring me.

I've even had a local attorney contact UPS and Staples in writing letting them know of my experience and that I would seek legal action if they chose not to settle the manner any other way.

UPS already has a class action against them for insurance, you'd think they would be a bit more careful of how they handle these things. Obviously not.
