Dishonest Advertising Company, Failed to Perform

I run a medical business, and was interested in advertising. A conniving sales representative came to my office to sell me a spot in his brochure. He promised me that I'd be on the inside front cover of a brochure that would be placed in the Edwards West Covina Cinema. He stressed that I needed to book that day, in order to get the best placement in the brochure. The total cost was about $1500 for a 52-week run in the Edwards Camarillo Cinema.

I made an agreement, and was even sent a proof for the ad. Over the next few months, I visited the theater several times, and never saw my ad there. I made several phone calls and emails to National Advertising Center (I later learned that the company's name was Video Reporter, Inc.). They insisted that the ad was in fact in that theater. After checking it several times with my own eyes, I saw that it was not.

Next they said the agreement with the theater had gone bad and they moved the placement to a Vons store (as their horrible contract allows). After dozens of phone calls and letter pleading with them to distribute my ad, it was finally placed ONCE at the Vons, but it should have been distributed many times by then. 2 other businesses and I decided to take them to small claims court for a refund, but we lost (I assume because of the way the contract is written fully protects these crooks— the judge gave no explanation). Now they are suing me and the other 2 businesses for "Intentional Interference with Contract"

Apparently we interfered with the contract by "calling and/or talking to representatives at Edward Cinema in West Covina, relative to distribution and calling other advertisers in the brochure where defendant's ad was placed to attemt to get other parties under contract with plaintiff to not pay money due plaintiff"

I am now in the process of talking to attorneys and finding other people like me who have been defrauded by this company. This company needs to be stopped. They are suing me for $10,000 just because I wanted one thing done: I wanted my ads to be distributed as promised. That was all - since they couldn't do that, I wanted my money back. I got a lawsuit by these crooks instead. Buyer beware!!! Read the contracts you sign... Their contract is like signing your soul away.
