We moved into Canal Place Apartments earlier in the year 2008. When touring the property we looked at a 2 bedroom configuration on one side of the complex. We were told that we could have this unit, as it was available.
Also upon our tour we heard a train come by the apartment, the apartment complex is located right next to a train track. We asked the person showing us the units, how often does the train run? (because from previous expierence we knew we could not sleep well with a loud train nearby). He said "Oh it only runs a couple times a day, i think it stops around 10pm and starts back up around 6am"
We came back two weeks later to sign our lease, as we were moving from out of state and we now had everything packed up and were ready to move in. On our move in date they told us that the unit was never available in the first place, but they has another just like it on the other end of the compound, and on the first floor instead of the 3rd.
Since it was realativley the same layout and price we said ok, On the first night we moved in after signing our lease, we heard the train ALL NIGHT, about 14 times between midnight and 6am. Also the unit we now occupied was much closer to the train tracks and faced the direction in which the train ran, so we can here it coming from a mile away.
We went and asked the manager what the deal with the train was, why is it running all night? And why does it have to blare its horn for a consecutive mile.
They said they were working on getting it to be a quite zone, closing down some pedestrian walk ways so that the train would not have to/or be allowed to blow. (6 months later its still not quite)
We were both exhausted with the stress of moving, and i was in the process of job hunting for the first 3 months of our move in. When things finally settled down for us financially and the stress of life subsided, we started focusing on the finer comforts of life, like SLEEPING.
It was then that we told the apartment complex we wanted to move out, because they had lied to us about the trian, and the apartment is unbareable because of it. They told us the only way to get out of our lease is to pay a reltting fee of 85%, as well as we had to pay all the remaing rent we owed up front, and once the apartment was rented again the money would be returned minus the rent which had accumlated in our abscence of living there.
I was finacially stable, not filthy rich. I did not have 13,000 dollars to pay all the remaing rent up front, as well as incur all the moving fees that existed with moving AGAIN.
I told them that this was unacceptable. I then pursued a complaint with the BBB, which lead no where do to the fact that they are not acredited with the BBB. (GO FIGURE).
I also filed a complaint with the HAA (Houston Apartment Association) And they forwarded my complaint on to the property mangement. (25 days later i have not recieved a response)
My next step is small claims, and there I will ask for a full return on my rent, plus moving expenses.
These Apartment managers are nothing but low life fraudulent scum, that live inside their lawless lease right.
