On 10/12/07 I phoned ETraffic Citation.com after being referred to Mark Peplowski by a friend of a friend. A lady named Lisa answered and I inquired about retainer fees for Mar Peplowski. She told me that Mark Peplowski funnels his calls through their office but handles his own cases that are not traffic related. She informed me that for traffic tickets, a flat fee is charged. I explained my situation of being assaulted at one of the local casinos to her and she quoted me (Lisa) quoted to me a retainer fee of $350.00 for a case that doesn't go to trial and $500.00 for cases that do go to trial. I told her that my case was set to go to trial, November 16th at 9:00am so $500.00 would be the retainer fee. She then took the steps to deduct the amount from my bank account. There was also an open citation where I made an illegal u-turn. This lisa person said that her office could handle that as well and I agreed.
As the trial date neared for the assault, I hadn't heard anything from Mark Peplowski. I phoned ETraffic Citation the week of October 29th '07 since it was the only number I had for him (Mark Peplowski) and was informed again by the same lisa girl that he handles his own cases. Not once this person offer up any way to directly contact Mark Peplowski. I told her that I understand but that I hadn't heard anything from him and it seems that since I paid to retain him, he would at least introduce himself and mention what work had been done thus far on the case. I was told "no news is good news".
On November 16th, I phoned ETraffic Citation at about 8:45am in an attempt to find out where Mark Peplowski was. Court was sheduled to begin in 15 mins. And I still hadn't heard a word from this guy, let alone seen his face. I didn't get a live person, so I left message stating that I was at the courthouse waiting.By 9:00, Mark Peplowski still hadnt shown up at the courthouse, nor had he tried to contact me. I phoned ETraffic Citation again and this time the lisa girl answered stating that she had no idea about the court date (interesting, since I informed her of this during our initial conversation) but that she was on another line with Mark Peplowski and he was supposedly on his way from North Las Vegas. Apparently, he didnt know where he was supposed to be at 9:00am either.
While waiting (for Mark Peplowski to show his face), Dist. Atty. Watson informed me around 9:15 that he was dismissing my case. Let me add that the courthouse is located downtown Las Vegas which is right next to "North Las Vegas". I called ETraffic Citation and told them that my case had been dismissed. The lisa person actually had the audacity to act as if this was a win for Mark Peplowski and started going on and on about filing paperwork. I told her that there was no paperwork to be filed and that they better not file anything on my behalf. I told her that all I wanted to see was a statement of billed hours so that I could see where the hell my $500.00 went. Her response was that I needed to speak to Mark Peplowski regarding the statement and then gave me his cell phone # (702/339-5408). She told me that if I left him a message, hed get right back to me. I left a message for him immediately following that conversation specifically requesting the statement of billed hours (around 9:30am 11/16/07). As of Sunday, 11/18/07, I hadn't heard a word from this man.
Late Sunday (11/18/07) evening, I phoned ETraffic Citation to again request a statement of billed hours (since I hadn't gotten a response from the cell# I was given). I checked with another law firm to find out if I'm entitled to a statement of billed hours and was informed that yes, I am entitled. My concern was just how poorly my case was handled correction, mishandled. Besides, it would have taken all of 5 seconds for this man to confirm with me that would send me a statement of billed hours.
Monday, November 19th was the first time I had ever heard Mark Peplowski's voice. I couldn't believe how ridiculously unprofessional he was. He had the gall to get snappy and belligerent with me which of course prompted me to return the favor. The nerve of him calling my office in a huff because I requested billed hours documentation that I have a right to! I'm the one who was swindled out of $500.00. This guy and this lisa person's stories were so screwed up! He started complaining to me about calling "everyday" and that "Friday, he was out of town". First of all, I phoned his cell# once the morning it was given to me and 2 days later left a message on the only business phone I had for him. Second, if he was "out of town" (which he informed me was his "right" to be "out of town") how in the hell was he on his way to represent me at 9am?!?!?!?!? He then went on to say that he would provide a statement of billed hours and he was also going to include the conversations that took place after I dismissed him the previous Friday (11/16/07). I told him to go ahead, just get it done and get it to me (I've got phone records too).
After this whole mess, I went to the person who referred these crack-heads to me and told them what was going on. She was appalled by what had transpired from this referral and decided to google this guy. Why did we find out that he got busted during a prostitution sting in Las Vegas called Operation PIMP a year prior!?!?!? After learning this information, I sent a fax to ETraffic Citation to the attention of Mark Peplowski stressing that he also drop the u-turn case and discontinue any legal involvement with me. I also asked again for a statement of billed hours to account for every penny of the $500.00 and refund any unaccounted for amounts. I didnt want to have anything to do with this pervert. I then received a call from that lisa girl going on about how Mark Peplowski doesnt have a retainer fee and that my payment was a flat rate. Go figure, how convenient.
I spoke with Dist. Atty. Watson on 11/26/07 who informed me that Mark Peplowski never once contacted him regarding my case. The people of ETraffic Citation.com (Mark Peplowski/Lisa Lemley) are trashy crooks who need to be stripped of their licenses and put behind bars. As of 3/19/08, I have yet to receive a statement of billed hours.
