Charged early termination fee even though we weren't under contract

My husband and I had been with T-mobile for more than 7 years. 5 of those years we weren't under contract. Well my wife lost her phone and needed a replacement. After 7 years of faithful service, we were hoping to get a deal on a new phone. However, they didn't care and In order to get a new phone, they required that we sign a new 2 year contract.

We really needed a new phone, but didn't want to sign a 2 year contract. Sensing our hesitation, the representative told us that we had 30 days to try the new phone and service. If we didn't like the service or the phone, all we had to do was send it back and it would just roll back as if we didn't sign a contract at all.

Well, we verbally agreed to this. However, we never officially signed a contract on ink and paper. Even though we agreed to a 30 day trial, we still weren't happy with T-mobile, so we went shopping and found a really awesome deal at Verizon. We ended up signing up with Verizon instead.

We called back T-mobile and told them we signed up for Verizon, so we don't want services from T-mobile anymore. The representative said that was fine, just refuse the package when it arrives.

That is exactly what we did - we refused the package. A month later we got a letter in the mail saying we owed them a $500 early termination fee. We called them and told them that we were supposed to have a trial for 30 days, not to mention that we didn't even receive the phone. They said it wasn't their problem. We had a "verbal contract" and we violated the terms.

As far as we're concerned we never received a phone, and they never provided a services, so they didn't fulfill their part of the bargain. Secondly, we never signed a contract. Our complaints fell on several managers deaf ears. All we got from each one of them was "That's not my problem, you still owe us $500"

We're not paying that money. I'm sure it's gone to collection now, but we're standing our ground.

They were rude, apathetic and deceitful. After all our years of faithfulness, this is how we're treated. Ridiculous.
