Fraudulent billing ripoff

Last spring my son started a subscription with my fathers credit card. He asked me when he received one of his bills if I could make a payment online for him and I did and when I did this the website asked if I wanted this card to be on file, I checked off no and made this a one time payment. I was billed 38.85. Ever since then they have repeatedly billed my credit card for 38.85 for a total of four times at this amount.in August I called sirius and explained to them what I did and that it was supposed to be a one time payment and that I dont receive services from them nor have I ever done business with them.

Not only that I have never owned a satellite radio or have ever done business with another company. I figured that would explain how wrong they were. Nope didnt work. I was told that I had to speak to my son and get his account info to rectify this situation. He cancelled his subscription and it was due to run out anyways.

In october they charged me again and I was out of contact with my son and did not have the info they required. I explained to them that they were stealing from me and that is not an ethical way of doing business. I then went online and contacted the better business bureau and reported them and my credit card company for their lack of cooperation on the matter. Both companies contacted me back through this agency. But of course in order to get rectification of the matter the better business bureau wanted to charge me a fee.

I did follow up on the emails from both companies and my credit card company told me that if I wanted I could close my account and get another account, I was not happy with that. I did nothing wrong and had some pending charges elsewhere, which by closing the account would have created a further complication for me.

I then in turn received an email from sirius apologizing for the inconvenience and it gave me a name and contact number to call back to get this taken care of. I called the number and guess what it was the sirius main number and they didnt know what iI was talking about. I gave up for awhile because at the same time when I had called my credit card company they told me they would not file a dispute for me on the matter. That I had to close my account.

IT gets better. On 1/20/07 I received a charge from sirius on my credit card again. This time I circumvented everyone and went online to the website for my credit card and put it in writing that I was being billed for services I was not receiving.

Please explain to me why I was not able to do this over the phone. They did take the charge off. Then just today 5/01/07 I went to pay my credit card bill online and it was over the limit by 9 dollars, guess why, a sirius charge.

I first called sirius and explained to them the whole history again and said that I was going to contact the Stae of Maine Attorney Generals office and file a complaint because they would not cooperate with me, the operator sherri refused to identify herself other than her first name. I explained to her because she became agitated that this was not personal but this had to be addressed and that I wished that she would let her superiors know that I was taking further action. She still was hostile, not swearing or anything but real uncooperative.

You know folks you cant get any clear cut than this never had an account with them, never done business with them, and they were stealing from me, literally. Now if someone had mugged me I would have had immediate recourse to the situation, but because this is a major corporation they can mug me anytime they want and I dont have any recourse.

I know some people will say what about your son, I cant reach him, and then some would say it was his fault, but not really stealing is stealing and there is no other way around it, I am clearly a victim and have tried to get this rectified if anyone knows of a lawsuit pending that I can be involved in please contact me. Otherwise I will be taking these folks to small claims court they didnt like that either. I would like to take criminal action against them because the charges are unauthorized.

When I first found this web site I thought take this with a grain of salt. Because no one likes to lose money or have problems. Guess what good for you rip off report and dont let the lawsuit make you feel intimidated. You are doing what is right. Concumers have absolutely no recourse unless they are well to do. My first search on your website was Bank of America and I did have a card but was having difficulty every month paying online. I registered but they never processed it and about a few monmths before I closed my account out I called them and told them this is how I pay online. They told me you could mail it and I explained to them that online payments are credited within 2 to 3 days that would be to late for first class mail and I was concerned because I was having trouble paying online and I didnt want to be late with them. Guess what the alternate website they gave me didnt work and I was late by three days, I guess I gave them the bat to beat me with. I had never been over the limit, had never been late with a payment. But the minute I piped up and said I was concerned about making a late payment I was locked out of both payment websites and was three days late and my interest was jacked up to 30 percent even with my explanation they would not rectify things. I closed my account had trouble with them getting it paid off because they were not giving me the right payoff info, and when it was paid off I insisted on a letter stating a zero balance so I could get rid of them. Then they started sending me statements for a credit of 15 dollars and I told them stop sending staements keep the 15 dollars I dont want anymore contact with you. They siad they couldnt do that, well they were right it seems they cant do anything right. So i said cut me a check and dont contact me again. Guess what they had pages and pages and pages of consumer complaints on this website.

GOOD FOR YOU consumer complaints. The companies that are trying to shut you down or make you conform to what they want dont understand what it is like to be ripped off because they are the ones doing it to us. How do they like being called for what they are. My case was clear cut, do i have any recourse, probably not because i dont have a lawyer at my disposal whenever i want one. If you have really been wronged tell it like it is. Maine is in the process of passing a predatory loan bill to stop people from being preyed on in mortgage situations, they also have a law on the books saying it is illegal for a credit card company to charge over 21 percent interest, so guess what the credit card companies moved to states that are not regulated. It is time we fought back, this is ridiculous what we as consumers have to put up with, my credit card company this morning didnt know when their dispute department was opening up at. They couldnt give me a time.
