Ripoff fraudulent refused to return money stole money jewelry

In July of I completed a live Ebay auction to purchase a set of 3 ct. Emerald earrings that were being sold by Neimans Live. I waited 3 weeks for the items to arrive and then started emailing this company to ask them where my merchandise was. There was no response at all, but the earrings showed up after another week.

Upon receipt, one of the posts of the earrings was bent, making it so that the earring did not secure properly. I contacted Neimans through the only point of contact I could find - email - and after nearly another week they finally responded with an address that I could ship my item to and they would replace it for me.

I shipped out the earrings approximately 2 days after getting their information, and after another 10 days my shipment was returned to me marked "Return to Sender". Again I contacted them trying to reconfirm their address. It took 2 emails and another 4 days to get a response.

By this time I was in the process of moving, and the package did not get shipped out. Once I moved and unpacked all of my belongings and located this package, I emailed them again to see if I could still return it. I mentioned in my email that I just wanted to do a refund on them, as I didn't like the way they fit anyway. This time Neimans responded right away and said that they would accept the earrings back, and a credit would appear in my PayPal account within 15 days of them receiving my package.

This time I shipped out the earrings via UPS so I could put tracking on it. They received the package on September 28th, and it was signed for by someone with the last name of Andrews (thank God for UPS's email notifications!). At the 12 day mark I emailed again to check on the status of it. It took another 2 days for a response, but they said that the credit would appear within 15 days, and asked if I would provide them with the UPS tracking number so they could check on the status for me. I sent this to them, and this is the last I have heard from them.

I have emailed this company 3 times with no response now, and am currently out both my money ($415) and the earrings. I can't seem to find any phone numbers on the Internet to call them about this - instead I found this site with an issue from June from another customer that has been ripped off.

DO NOT DEAL WITH THIS COMPANY!!! It will bring you stress and a lighter pocket all the way around. If anyone who has been able to talk to them has a phone number so I can try please feel free to email me at mamashaman @ yahoo.com.

My next steps are to appeal this company trough Ebay and PayPal... Hope I have better luck!
