Workmans comp Wrongfull Termination

When Injured on the job back in problems started immediatly after I was treated at a hospital in Kilgore, TX. E.R. Doctor stated to me, inury was a result of a work related injury. I immediatly notified the proper authorities with in U.S. Xpress i. E my Dispatcher amd Saftey Dept.

SAfety Department and Workmens Comp division, immediatly strated saying things about letting me go to a local clinic for a consultation and further evaluation in Kilgore, but didn't want to pay for any type of transportation to Shreveport, LA about 65 miles away, to a clinic they use in the local area. After injury was diagnosed but not to the full extent of exactly what the injury was, which later was a herniated Disc in the Lumbar area, my driving privalges where suspended

My Truck was reasighned and I had to call my dad from Louisiana, about 5 hours away, to come pick me and my stuff up!!! I made arrangements when I got back home to Mississippi to report to light duty in Tunnel Hill, GA and report in with Ms Jill Hall, human resource person, to which I thought I knew very well!!! After repoting in with Jill, and getting set up with the local Doctor to further my injury situation, The Doctor refered me to more test. U.S. Xpress decided they will try therapy 1st then see if anything needed further!!!

During all this time on light duty, I started going through a depresion due to the injury, to the point I wasn't eating or sleeping, and after a few days of this I got to the point to where I was feeling very mentally down. I tried to talk to people with the Physically therpay place I was at Benchmark Medical, but concernes feel on def ears, which added to the depresion more. I wasn't getting no where with the workmens comp deprtment on pay roll or nothing, plus the fact of being more then 500 miles from home, and had to make my own arrangements for the weekends.

Not knowing how long I would be in therpay, I begin to wondered when I was going to be home next. All adding to emotions. I tried talking to people in workmens's comp and others with in U.S. XPress, but def ears again. One morning I couldn't take the stress due to all these things I decided I needed further medical help, and decided to take some medical time off to see about this. I called into Jill Hall and got her voice mail. Being she wasn't due to be in work untill anopther 1.5-2 hours later, I left a mesage on her voice mail, to put me on a medical leave. When I got home later that afternoon, the next day I called to talk to Jill who also had my cell number just incase she needed me while I wasn't at home, i come to find out she took my job from me. I asked her why, she said "It is up to me to determine if you can go out on medical leave"

I didn't think much at that time knowing I was just fired from my job, but they listed it as a voluntary quite. Later on, I found out I was not rehireable with U.S. Xperss saying I threaten some one at U.S. Xpress. I submited in Writing after I found this out, just who I threaten. I am yet to get any response back. This has been more then two years ago now.

I was with U.S. Xpress for 3.5 years. I was one of there best trainers, and being the Fuller family over all was suspose to be religous people, beware of wolf in sheeps' clothing. Now Liberty Mutual, there workmen's comp insurance, they work hand and hand to mess over the injured worker. Which is anotehr Rip off I will submit
