Ripoff breached contract didn't provide service, turned termination fees over to collection agents

I started with T-Mobile in the late summer of on the advice of an independent phone retailer in Houston. I was an insurance adjuster heading to Florida to handle catastrophe claims from hurricanes Francis and Ivan. I subscribed to a nationwide phone plan with no long distance or roaming charges, plus a wireless internet number to be able to access the internet in disaster areas. Phone service was originally okay, although the wireless internet adapter they sold me for $300 seldom worked.

Once I got to Florida, I decided to stay, and ended up in Milton, near Pensacola. When I moved into the home I rented, I found that the phone didn't work there. I called T-Mobile numerous times, and all they ever did was argue and tell me that it "should" work fine there, but it didn't. Stupidity abounds at T-Mobile. The calls I placed to them about no signal and dropped calls would even get dropped. Finally, I threatened to discontinue my service with them if they didn't get the problem resolved.

They didn't fix the problem. Then I found out everyone in Milton who had had T-Mobile had the same problem. So I cancelled and switched to another cell phone provider, and everything worked fine with their phones and network. T-Mobile came after me for the early termination fee of $200 on the phone and $200 on the wireless adapter number, and I told them in crystal clear terms that I was not going to pay it, because they hadn't provided the phone service I had contracted for, so therefore they had breached the contract, and there now was no contract. No contract = no early termination fee. Nothing to terminate.

They still haven't given up, and harassed me constantly all through 2005. Now they have AmSher their newest collection company) calling my 73 year old mother and harassing her, even though I have thoroughly explained to T-Mobile personnel the law concerning contracts.

They are inherently stupid though, and just keep on trying to collect money that I have made clear they are never, ever going to get. I guess I have to go file a claim in a local court and get a judge to issue a ruling on it.

If anyone else has poor reception and cancels, they cannot collect your "early cancellation" charge if they did not provide you with the service you contracted for.

Since they are attempting now to ruin my credit report, I will now attempt to ruin their ability to rip off more people, by posting as many of these on the web as I can, and of course I'm telling everyone I know about it also.
