An eBay buyer who was not paying finally submitted an email address for us to process payment on paypal.com. We got paid and a week later there was a chargeback. This is our first chargeback. I emailed Paypal and asked why. They said there was fraud and respond to several questions which I did. Then they respond saying I did not have a tracking number. I called and gave them my insurance number from the Post Office. Today they emailed me saying that their terms of service require an online tracking number. When I asked for the name and number of their company president, the rep said they didn't know. I got a number at Palo Alto, CA which I plan to call tomorrow. I wrote them the following email:
I don't understand the matter or your company. Before I explore legal remedies to this matter, I want simple straight forward answers to the following questions: 1) Does the buyer claim that the item was NOT received? 2) Does the buyer claim that they DID NOT authorize this payment? 3) Does the buyer claim that they are not the individual behind this transaction? 4) Is the buyer and you claiming that I committed fraud in any way whatsoever? Further, please be advised that the U.S. Post Office tracking service (which costs 40 cents per transaction which I will now start charging each customer and stating that you require this additional cost to insurance) does not meet your so call Terms of Service because they do not provide online tracking to the destination. The Post Office tracking service only states when the item was delivered. Only FedEx and Airborne provide online tracking to the destination. But they only allow you to insure up to a certain amount when shipping artwork. So it is clearly a Catch 22 for sellers who deal in art. I am therefore requesting this information from you. If I do not received full and complete response to my requests above, you will leave me no alternative but to contact the Attorney General offices in California, New Jersey and New York as well as the Federal Trade Commission.
So has anyone considered or is there a class action law suit pending against this company? Thanks.
