As a legal researcher I filed a case against Sprint and AT&T back in 1998 on many illegal charges. I use no lawyer as I am capable of doing his for the last 30 years. This can be seen at www.atgpress.com When there click on cases of importance in lower right side.
The case is still in limbo since 2001. I picked the Federal Excise tax (FET) and started a administrative action in 2004. You can follow the articles on atgpress that have "new" beside them.
Sprint CEO and president Len Lauer, by tacit procuration, admitted that I was correct in that the regulation was repealed 1965, the statute in 1968, there is no Form for collection and the Office of Management and Budget removed the OMB number. That is not on the site. However, This response from Len Lauer generated a letter from Legal analyst Amy Shoenfield, see Letter of inquiry on atg site. She said I did not have top pay this tax at all.
After two months of trying to find the correct Sprint office to consumate this and stop the FET. That was the Executive Offices of Sprint in Tarboro, NC. Debbie Tate and Steve Davis, both Legal analysts stated by letter and phone conversation that yes I do not have to pay this excise tax after they receivesd a letter I sent to Charlotte FBI informing the FBI of Criminal activity.
On recorded phone conversation on 2-11-05 both Debbie Tate and Steve Davis said all I have to do every month is circle the aqmount of FET and write on the bill "I protest this charge—not paying — please credit my account". They also gave me credit for three months back, but I said whoa, fraud says there is no time limit and I can go back to 1965 if I want but will go back to 1998. They said no and only issued be credit for three years. I started receiving credit every month for the FET starting in March this year.
Now all of a sudden Steve Davis called and said I did not send the protest to London Kentucky and there is no credit on this months bill. So they are playing games and I and the intervienor who came on board with me, a paralegal, want to file a class action criminal and civil charge but only lawyers can do this. But those lawyers would face losing their bar card, there is no such thing as a license. The response O got from AT&T early on as well as Sprint said what I was doing would bankrupy all phone companies or they would have to refunds everyone in the country the FET over a 10 year period.
How do you like getting ripped off paying a tax that was repealed back in 1965 and still being collected by the phone companies who arer pocketuing the money as they have no Form to present for them paying the tax. I haqve the original 1898 Phone tax that was for the Spanish American War and only the phone companies, not the consumer, was to pay the tax written right in the statute.
When I demanded through discovery the Statute, the regulation, the Form and the OMB number that supports Sprint's collection process, they could not produce anything. The CEO said probably, lets get rid of this man and pay him so he don't jepordize our scam.
So what can you do to help get this info out to people that do not even know atgpress is out there so we can get some relief?
