Concerning the many complaints or third party service of obtaining FEIN tax numbers, there are two areas that beg for clarification. They are contained in the IRS instructions as follows.
When the taxpayer calls the number 800 829 4933 the IRS employee will take the taxpayers information validate and give the number over the phone.
If a third party applies on behalf of the taxpayer, authorization must be indicated on form ss4, submitted by fax before the number is issued.
If either of these two instructions were followed by the IRS none of these complaints would have occured.
We can expect the IRS to defend this unlawful practice due to the complexity of the vast numbers of invalid EIN that are in use. We should however expect some regulation of the fees charged and many refunds are in order.
