Refuse to Refund Holding Deposit!

I contacted Property Services of Atlanta, INC, on July 12th, inquiring about properties they had for rent. My point of Contact was Scott Gober. Over the 4th of July weekend we asked Mr Gober will he be available to show me and my wife houses that weekend, and he stated he was going out of town and yes he was in the area. When we reach the property, we called Mr Gober, after waiting on him for an hour, he finally returned our call and instead of coming he just gave us the codes to lock boxes to view the houses on our own.

We were still undecided, and decided to view other property's the company had listed. The house we chose was in a different area than original planned. We called Mr Gober back a few day later and told him we had settled on the house in the new area. Mr Gober stated that we would have to put a five hundred dollar holding deposit on the house if we wanted it. At that time we asked him would we be able to receive our holding deposit back if we changed our mind, and he said yes. We sent Psatlanta, the money plus the applications fees. After that Mr Gober never call me, to view the house. I had my wife call to set up an appointment to view the house for the 13th or 14th of the month. My wife is stationed in Virginia Beach Virginia, and set these appointments up with Mr Gober, for me to view the property since I am in the area. Mr Gober never called me to confirm the appointments.

So on the day of moving in, after several calls not being returned, and we haven't had a chance to view the property yet be decided against going with this company and I just move to Virginia with wife and kids. We called them on the morning of the 15th and told the receptionist that we did not want to go through with the date of move in, and could we get our 500 dollar holding deposit back. At that time we were told to call back, after several hours of calling back, because they wasn't answering our calls. I finally was able to reach a receptionist who stated to me that Mr Gober was not in the office. However at the same time he was on the phone with my wife, and told her after she requested the money back its not his fault that she could not read and saw that we had 72 hours to change our mind. We have not signed in contracts with this company, only an application fee to pull our credit reports. I am seeking Psatlanta return my five hundred dollars minus the application fee, for not disclosing this information before hand.
