I am the owner of a brand new house on which a CO was issued with pre-existing major problems. Surface water constantly running towards well, septic system and foundation, undermining property, making it inacessabile and forcing owner{a senior citizen} to spend thousands to make home habital. Builder never returned to remedy, builder"s lawyer never responded to appeals by owners attorney.
Every State agency contacted: EPA, DEC, Building code enforcement, Governor and Reps. All agree this is a serious problem but are not regulatory and can not force the issue. No one has offered a solution to these conditions except to hire an attorney, which is impossible due to no funds. I have had to purchase gallons of drinking water each week, replace filters in system every seven days @ 70.00/per, drag the water up basement stairs, because the walk sinks in the saturated soil.
The difficulties go on and on. I can"t rent the house, can"t sell the house, but continue to pay the mortgage. The mortgage company takes no responsibility for allowing or even checking that the CO was legitimate. I feel that there was corruption and colusion on the part of everyone involved in making sure I closed on this fiasco. This is an ongoing Rip Off and if anyone out there knows how to get some justice, it would be greatly appreciated
