Land/Home seller: Southern Belle Modular Homes a dealer of Precision Homes:
Property constructed in 5 with intent to use it by the seller as a model home. Listed for sale by local real estate agent around 8 as ready for occupancy. I placed a contract on the property in 9, and the seller was asked for property disclosure. Upon their acceptance of the contract, I had 10 days to inspect it and continue with the contract. It was then disclosed to me after I asked to have the water turned on to flush toilets and run water to the home that the home did not have a well or septic tank system.
The seller did not want to put them in till after they had proof I was going to be able to finance the home.in 10, the seller installed the septic tank and well. Assured me during closing that the septic tank and well would be fine and the installers would warrenty their work.
Upon moving in and closing on 10/25/04, it was discover that the well water was full of fine rocks and contaminated with bacteria. On 11/26/04, the septic tank backed up and! Has not worked since. Georgia health inspectors have inspected the system and French drain have been installed but the system does not work. I have discovered there has not been a perk test done on the property, but a permit to build the property was issued on both a state and county level.
A second test on the water was done on 1/27/05 and it returned as positive still for bacteria. I have hired and had a soil scientist to perform a soil test as of 2/3/05. He tells me a house should never been built on this property. I am a single mother of two sons 14 and 17, and we have experienced intestinal problems since we moved in, but stopped drinking the water or cooking with it in 10.
My eldest son recently was ill with nausea, vomiting, diarrhea to the point of dehydration. I need help finding an attorney in my area that will help me get out of the real estate contract and return this mess to the seller. Please help...
