We entered into a conditional we thought contract with a builder Cono in Rio Rico Arizona. The condition was that our property had to sell in ordered for us to purchase the builders house. Ana our realtor who was suppose to be represting us her purchasers did not follow through. Ana was given all the contact information of the realtor who was representing our home sale. Unfortunately our home did not sell within the time limit of our contract.
Ana was fully aware of this fact, we have documentation from all the contact with our agent. Ana was aware of the fact that the communication with us would be through the realtor as we do not have access to the internet at our cottage.in the end Ana sent a form to be signed which our realtor and I assumed was for our two thousand dollar deposit to be returned. I signed the form my husband did not. After Ana and only after did Ana our realtor tell our realtor we would not be getting our deposit returned to us how sad.
Ana knew when she sent the form she was not going to return our deposit why didn't she make us aware of that the form never spelled that out our deposit was being given to the builder. Ana has given several different virsions of why we didn't get our money back all documented. But in the end here we are the builder has our money and we are devastated. This house purchase was suppose to be a happy experience my husband has survived a serious illness. But for us dealing with Ana Meek and Cono builders has been a nightmare these people have taken advantage of us without any conscience. I don't understand why anyone would enter into a conditional sale or why would any competent agent put their client into a situation where if their house didn't sell they would lose their deposit.
