This is a email I sent to a man at Time Warner today who is trying to help solve a problem I'm having with AOL. I spoke with him Saturday after the fraud supervisor at AOL tells me Time Warner is still billing them for my Hi-Speed Internet. Time Warner moved out of the area over 5 years ago and quit providing service where I had me office so I used dial up service. I sold the place in 2006. I've been billed for Hi-Speed Internet service for 6 years that I did not get nor could I get. Now that this fraud supervisor knows I've been in contact with Time Warner, I even sent her a link to prove my point that Time Warner sent me, she says she wants proof that Time Warner would have told them my service was disconnected. She doesn't seem to get the fact they were partners at the time and AOL was selling and billing for Time Warner. Time Warner has no data even showing I had their service because they didn't need it, AOL had it and was handling everything. I thought I was paying for a business AOL account and email until last week when there was a billing problem and I had to call AOL and then I asked why I was paying so much while everybody was getting free service and I was told it was for the Hi-Speed Internet service. I might never had known and been charged for years to come. I've paid between $3,000 and $4,000 for service I wasn't getting and couldn't get and nobody will help me with this so I'm moving up the ladder and will not stop until this is resolved. I keep getting told about TOS and a lawyer told me TOS can't break the law and my being charged for services not rendered is breaking the law. Law is more powerful TOS. I have a house painting business and I can't charge for painting a house I didn't paint. I have filed a fraud case with my bank and they say its illegal but they will only refund my NSF fees that AOL caused on my account when it was down from another fraud problem. 2 lawyers say its against the law to be charged for services not rendered, but AOL's own fraud team doesn't think so and if calls between me and them are recorded, you can hear the lies I've been told. Its amazing some of the things I've been told. If I have to make this get real ugly to get my point across just because of principle, I will. I'm hoping to keep it easy and not rock the boat but somebody better do something. Fraud supervisor is Jenny, her ID is 68596, oh, and she offered me 4 months refund, a joke at that. Hi Brant. I just got off the phone with the Supervisor of the Fraud Dept at AOL and let her read that article about Time Warner leaving Houston. I don't know if calls are recorded there or not but I told her I was floored that she told me Friday that your company was still billing them for my service. AOL was selling your service back in 2002 I think it was, and they were billing for your service, that's why I think you have no record of me. AOL and Time Warner were partners then so as long as one had it, that's all it took, my guess anyway. I told them they would have known that my hi-speed was disconnected because of the partnership. Jenny, the supervisor, says I should have called in and changed my plan and that because I didn't, that is why I've been charged the price I've been charged up until last Monday, Sept. 26th. The problem I have is regardless of whether I called in or not to change my price plan, they can't charge me for a service I was not getting. She said they had no way of knowing I wasn't getting it. Their TOS says I need to call to change my plan. I was told law would override a TOS. Fraud is just that, Fraud. I had dial up after your company left and that was my AT&T phone line. Like I told you, I have sold that place long ago and if I hadn't called when I did, they would have just continued to bill me for what I thought was a business account, but was hi-speed Internet through your company. She says she needs proof that they would have been notified of my disconnection. Not all AOL customers that had your service that disconnected, but me. I feel like I'm beating my head against the wall with AOL, but any help you can provide I would really appreciate.in the past week, you're the only one out of probably 50 I've talked to that even has common sense. I've even been told its not an AOL problem, its a Time Warner problem. Is it possible that your company is still billing AOL for that service? Silly question I know, but had to ask. Let me know what you can come up with about all this mess. It just doesn't seem possible this has happened, but to get nobody at AOL to understand.
