Aka cnac rip-off!

I am writing to hopefully get some help with an ongoing problem I am having with JD Byrider. I purchased a car from them in May of last year and I have continuously had issues with this car and them since then. Just recently, I almost got into an accident and it is because they never fixed my car like they claim they had. This is my story:

January 15
For months my car had been making this noise and every time I took it in to be fixed (at JD Byrider), it would be okay for a week or two and then the problem would come back. I constantly called JD Byrider and CNAC and complained about the car they sold me. I was promised a rental but never got one. They would fix the car in a day every time it was brought in and it seems as though they fixed it that fast to avoid giving me a loaner or rental.

When I went to get the car the next day, I believe, it still had the noise and drove in the same condition as it did when I took it in. I called and complained and they told me to bring it back. I brought it back in and Mike called and said that the car appeared to be fine. He said 3 different mechanics took a look at it and they all agreed the car was fine.

Mike and I test drove the car together and when I asked him what that noise was he told me it was just my exhaust but in the same breath, informed me he didn't know a lot about cars. I told him that my exhaust has never sound like that before and he reassured me that it was just my exhaust, there was no problem. I told him I did not want to be driving one day and get into a wreck because my car wasn't fixed properly.

I took the car home and for 2 months the car continued to make this loud noise. On Saturday, 3/20/04, I almost got into an accident on the expressway on my way to Lorain. I heard something pop and the car refused to go in the direction I wanted it to go. Luckily there were no cars behind me or me and my daughters would've been in a serious accident. I contacted Dana at CNAC and asked her if it was somewhere else other than JD Byrider in Sandusky that I can take the car to because I was scared to drive it back home. She said she would find out what she can do and call me right back. I never heard from her.

Monday morning I called again and Amanda informed me that Dana was probably busy and couldn't call me back. She said that she was taken off my account and no one is assigned to it. That made me feel like they really don't care about this ongoing problem. I asked to speak with the lawyer at their company, whom I spoke with before in January and Dana said that she would see if she was available and if she was, she would transfer me to her. Dana transferred me and I got the voicemail. I called back and they transferred me again, and I got the voicemail. The lawyer never called me back. I have been discouraged from calling CNAC and JD Byrider because they show me they really don't care. Mike told me one time before that he didn't care, they were still gonna get their money.

March 22- I called JD Byrider and expalined to them that I almost got into an accident Saturday and that this car needed to be fixed right. The mechanic told me that I can bring it in but he wouldn't be able to fix it until April 5th. I told him I couldn't just go without a car because I have to work. He showed the same attitude as they always do, he didn't care.

I decided to go to a different mechanic. Bob at District Tire Center, informed me that this car did not appear to be fixed properly. I called Mike, the manager at J.D. Byrider, on 3/23/04 and he informed me that on 1/15/04 they fixed my right front wheel bearing. I told him that Monday, 3/22/04, my right front wheel bearing was fixed by another mechanic. He then spoke with the mechanic who supposedly fixed my car on 1/15/04 and the mechanic said he fixed my right hub bearing.

I called Bob, the mechanic at DTC, and asked him what was the difference between a hub bearing and a wheel bearing. He informed me there was absolutely no difference. I called Mike back and told him there was no difference between the two and he told the mechanic, which the mechanic then admitted there was no difference. The mechanic then informed me that it wasn't actually the right wheel bearing they fixed, it was the spindle assembly and the right wheel bearing is on there. The receipt that I have from them clearly states wheel bearings and ball joints were fixed. Nowhere is there a spindle assembly. When I asked why it wasn't on there, the mechanic told me because he forgot to put it on the receipt. I explained to him that because it doesn't show on the receipt, I have a hard time believing they really fixed it.

He then proceeded to say that he would see about a reimbursement. He covered the phone up and I heard him ask Mike if they could reimburse me because if the piece is messed up then it would be their fault. I also heard him say that they got the part from a salvage yard. When he returned to the phone he informed me that if I brought the piece in for them to look at and it appears to be messed up then they would reimburse me the 50 dollar deductible I paid when they supposedly fixed it.

I told him that it's costing me 110 dollars to get that fixed and he said that when they (supposedly) fixed it in January, they fixed it for free even though it wasn't in the warranty. He said the part cost 193.00. My receipt says $193.80. It showed $100.00 for the labor, $93.80 for the sublet and $0.00 for the parts. When I questioned that, his response was oh. He then proceeded to say just bring the part in and we'll go from there.

I asked him if the part was new that they put on in January, should it have gone bad in 2 months. He said no. I also asked if the part was a good part, would it need to be replaced and he said no. So my question at that point was why would he need to see the part then if its obvious the part they put on was a bad part. He had no answer and just told me to bring in the part. The conversation ended.

This, as i said before, is an ongoing thing with them. Truly I am ignorant when it comes to cars and they saw right through that and took full advantage of me. They see that this car is a problem and will do nothing to resolve this issue. I am paying $13,000 for a 96 ford contour and when i was told that was too much i questioned them about it and he told me they put a lot of money into putting new parts in the car and that is why it is so much.

Bob at DTC informed me that the struts on the car are not new. They are rusted and they are the original struts ford put on the car when they made it. I have spoken with some lawyers but no one seems to care. The minute I mention JD Byrider, they laugh.

I feel humiliated and taken advantage of and every two weeks I am paying for a car that i can't even drive over 40 mph in. I hope that you can help me in some way. I am sure that i am not the only person they have taken advantage of because Amanda at CNAC has informed me I am not the only person complaining. Please help stop this problem with JD Byrider. Anything that you can do will be greatly appreciated.
