My Finance Nathan and I, Kristin decided to our wedding reception at this establishment on August 13. The owner asked us for a down payment. We gave him $2000.00 in October. On 05/04 my Father passed away and we decided not to have a reception. We contacted Chandani in May and spoke to a Dean Khan. We told him what happened, he told us to come in to talk. My Fiance Nathan went to meet up with him. He suggested us to the contract, it clearly read on the bottom, no refunds for any unforseen event and denied us of our refund. We then asked to speak to the owner.

In July we went back met up with the Owner Sohail, he told us the same. His reason for not giving us our deposit is that he would be out of $20,000 thousand for that day because he held the day open for us and that he has no other replacements for events because we gave them such short notice of a death.

We recently learned that the restaurant is holding an event in the same hall that we had reserved for our wedding reception for 500 people. The owner lied to us on why he would not give us our deposit. The deposit was to hold the date and now the date is filled but another family holding an event.

Is this legal. Should we be able to receive our deposit back?
