I was recently sent a default, affidavit, entry and judgment (sum certain) I did some research according to Federal law. All cases in credit collections being tried in a county are to use the notary public from the county in which they are being tried. If they come from a foreign county the plantiffs and courts can be fined. I am looking at a debt I cannot afford because I am already economically strapped.
In Michigan you have to have according to our States Attorney general and the United States Attorney general an hand written signature in order for a judgment to be enacted against anyone who is being sued for damages.
The person in question being served is the only party allowed to recieve this information. The consequenses for this failure is charges under applicable identity theft laws. Both this firm and the court inquestion are going to have to pay restitution to me.
I lost my employment in 2005 asked the original firm that handled the account for insurance in case I was off more than six months. It exists they allowed the interest to just build and build. I had a conversation with several other law firms in the area that indicated that they are know for not obtaining a signature. If you don't have a current signature then you do not have a case. I am seeking defamtion of character charges against this party and its fellow plantiffs. I don't have any money to pay this because I have been up and down.
