Westwater construction and mark miller is about to see the inside of a courtroom and from outside sources, will be brought up on theft charges involving another contract he took money from and pocketed some 44,250.00.
Sources indicate that they have PROOF MARK MILLER, President / Owner of WESTWATER CONSTRUCTION Company was PAID for various Projects in a Condo Contract but kept the money and never paid the sub-contractor of numerous projects completed. According to outside sources, the sub-conmtractor has " proof " the units closed and Mark Miller was in fact PAID for various completed units, but instead never paid the subs involved.
Sources indicated a lawsuit was filed in Hillsborough County Court on Friday, October 7th and that process service is being made upon him and his Attorney/Agent by process service.
Sources have indicated that Miller may also be facing Criminal charges which will be filed against him and his company "after" the Civil Judgment is obtained. It has also been established that the Attorney General and the SARASOTA Districtb Attorneys office and The Department of Financial Regulations aqre waiting the outcome of the Civil Lawsuite and Judgment. The judgment is necessary in order to conduct a Criminal Investigation into the Theft of Money obtain by Westwater Construction on a sub-contractor. If Miller is investigated and the findings are that he. Obtained payment on the various units the work was performed on, then the State may bring Criminal Charges against Westwater Construction Company and its Owner - Directors - and specifically Mark Miller.
It has been learned that the Plaintiff has sufficient proof Miller was in fact PAID for the projects the sub-contractor was involved with, completed but never paid the subcontractor.
Miller is now liable for not only the back amount owed, but in addition Court Cost, Filing Fees, Process Service fees, Attorney fees and Interest. According to outside sources the Plantiff will under NO CIRCUMSTANCES ARBITRATE the case at TRIAL.
Sources have indicated that The Plaintiff is seeking all of the money lost, plus out of pocket expenses to date and will be contacting the State and governing agencies both state and County levels to bring charges against Miller, but prefer to see Miller put in JAIL for the theft.
