Refused to give car after committing to "legally binding contract"

Below is the story of my nightmare with Lipton Toyota. I've listed the series of events in order:

- I purchased a 2008 Pontiac Vibe from Lipton Toyota on ebay (or so I thought) for below book value.
- The listing stated to contact Rafael DaSilva, Internet Manager. I contacted Mr. DaSilva immediately via email.
- He replied back the next morning saying "the car did not sell for what we expected it to. We should have listed it for a higher price. We will not be selling it."
- So first of all, this was Lipton Toyota's first sale online. Obviously when he wrote this reply he didn't realize that ebay states that if an auction goes off it is a legally binding contract. If an item sells for less than expected, it is not grounds for dismissing the sale.
- I wrote back and forth with Mr. DaSilva who kept getting more and more rude through email to the point where he was basically taunting me. To say he was disrespectful would be an incredible understatement.
- Mr. DaSilva kept blaming the "new sales rep" that listed the car, but according to the item description he was the one who listed it.
- As usual, ebay was of no help.

I guess this is what you get when you deal with used car salesman, but this went beyond anything I've ever seen. I should have read all the reviews about Lipton Toyota and how they engage in shotty business practices. Please save yourself and avoid them at all costs. They are absolute con artists.

Joe
