Deceptive company steals security deposit, makes up lies and, beaks the law

We were one of the first families to move in to Kenton Crossing in may. Their property manager at that time was a nice lady named Kim, she was gone there shortly (aprox 3 months. This seemed to be the norm in the time we lived there (3 years) they replaced the Prop. Mgr. Almost twice a year and with the changes it always got worse.

Apon signing the lease before we moved in, we were promised a ground apartment because we had children we didn't want them disturbing anyone below us. We did all the moving paperwork like change of address and DMV. Six days befoe arrival from Georgia (where we moved from) we got a phone call asking us if we would be willing to move in to another apartment on the seccond floor. We told them we agreed on a ground apt. Because of the kids. We were offered the apt. Above the model which seemed fair. We agreed to move in above the model and once again changed out address and dmv info. 3 months later, a new property manager and they decided to move someone in to the model below us. We told them why we were where we were and we told them we had children that may bother people below us and we made arangements with management regarding this. We were told we would not bother our new neighbors and not to worry about it... Well, guess what... We got bangs on our floor from the woman below us even when we were not moving around... Problem never solved... Because not in writing.

To give a few more examples of how things are run there I will explain a few other situations that happend on the property and how they were handeled. We constantly heard the people above us urinate, I think anyone would find that rather discusting but to make it worse we could hear them have sex. Everything from moaning to the bed springs squeaking. I could no longer tolerate this and told them of this and was told there was nothing they could do.
The people above us constantly banged, had parties, and had fist fights in the hallway. There was blood on the ground for 2 months that they refused to clean up. Nothing was ever done about these people, we suffered their abuse for two years.

Two cars were stolen from right infront of our building... Wonder who had in on that? The neighborhood children had rock fights in the parking lot and I called the most recent Prop Mgr. Jay and he went out there and talked with the kids and never checked out the damage to the cars... I know there was some because I could hear rocks plunking off cars. The older neighborhood kids often beat on the smaller ones while parents watch. During the snow this year O got a dent in the side of my car from the kids shrowing snow or ice balls.

Our cars were wrongfully towed (both of them at the same time) and were not returned untill the next day because the Property manager at the time (Juanita) left early that day and she is the only one that could call the tow company to return them. The next day she had them returned for us all muddy from the impound yard and neither the tow company or Kenton crossing would have them cleaned.

In the lease it states that you may not work on your veichle on the property. On numerous occations we witnessed some of out maintence guys working on one of the residents cars in the lot... infact he changed the oil... Wonder why maintence ppl are doing personal favors that include breaking the rules for cirtian residents.

As far as repairs go... We awoke one morning to our smoke alarm going off and we saw water pouring out of it. Turns out the flooded their apartment upstairs by overfilling the washer and it drained doen in ours and the one below us. They came in our apartment and took the detector doen, set it against the wall and there is where it stayed for the next 6 months... Noone ever came back to clean the water damage or even call... Even after we called them to replace it they told us "we have one on order" that was 3 months after and it took 3 more months to finally get them in to install it. Our Ac frose up numerous times and no fix... We were told to wait till it thaws... Their drain pans overflowed and made the floor wet... The carpet was nasty from it and mold started to develop.

Someone above spilled cola right infront of their apartment and it dripped down on our door and entrance. I called and told them but noone came to clean up the mess. It was tracked in on the carpet.

We were on a month to month lease and were notified 8 months in to it that there was no such thing as a month to month lease there and we needed to sign a lease or leave in 10 days. We had no choice with nowhere to go. They told us we were overcharged for rent and they refused to returned the difference. We were told that the people involved in the overcharging were fired but they would not explain what had happend and why we were overcharged... THEY REFUSE TO TAKE RESPONSIBILITY FOR THEIR EMPLOYEES AND ACTIONS.

Finally after three horrible years of torture... We moved out... We cleaned that apartment and left it empty and in good shape aside from the flooding and black mold growing. We called the rental office the day we were moving as we were told to get a walk through and was told it would be some time before they could and we had a screaming baby so we could not wait. We gave the keys to a leasing agent and a maintence guy that was doing nothing (maybe he could have done the walk through) and told them we could wait no longer and gave them our number to contact us for the walk through... No contact... Nothing... Finally I called 25 days after we moved and were told we painted a wall and the painter had to put two coats of paint on and he charges $80 a coat so we were charged $160 for paint for a 2 bedroom apt. We were told there was some trashbags there $20 for the bags of trash and $40 for the blinds. I was told all this on the phone and since then they refuse to return my calls and its been 50 days since I moved. Virginia law says they have to send you in 30 days in writing what was taken out and the remainder of your deposit and they have 45 days to send a list if another contractor is used... Its been longer now and they are in violation of the law. My deposit was $250 and I want it back plus interest for 3 years and 3 months.
