My children are being cheated out of their rights

I am a divorced mother who relied on the Texas Attorney General to do their job. I don't expect more. My ex husband was supposed to pay child support... He did but only because I paid $15 at the end of the divorce hearing to have the money garnished from his pay.

All was well while he was active duty. Then he retired from the military with 20 years service. He retired in September. He began sending money and the check bounced... That's right sending money because all of a sudden the garnishment didnt work anymore.

I went through setting up garnishments all over again. His check bounced, he was supposed to pay it to them... He didn't. Then he requested a modification hearing in December. I had to take the day off work because with the Temple office it is an all day event.

The attorney I dealt with advised my ex husband that he was to pay $591 per month starting Jan. This decreased the child support order that was origionally $827 per month. So the arrears he was supposed to pay for October, November and December for the $827. He had made payments in each of those months but the three combined payments left him owing almost 800.00

So then Jan comes around and he sends in 579.00. Then Feb was 428.00, same for march, same for april, same for may and same for june. I contacted the Attorney Generals office and was told at the 8002528014 that I should be happy that I am getting child support because not everyone gets it. And why was I complaining.

I explained to the rep that I was NOT getting anything. This was money for my children and to help take care of them. Yes, it was something but that amount doesn't begin to pay for even half of their living expenses.

So the attorney generals office said that the amount he was sending is based on his retirement. I said what about his job? What job they asked... I said the job that we discussed in december. Your office has his pay stubs from the employer and the retirement pay from the military.

He is making almost 3800.00 per month. The state of Texas says that for our children he has to pay 25% of his pay before taxes. So if you do the math its $950 give or take a few dollars. I filed a complaint on their website, actually I have filed about 20.

Today a woman called me and said that my exhusband is on limited garnishment because he only gets retirement... So here we go again. I told her to just stop talking and look in the file and she would see that he is working full time for the state of Georgia. She placed me on hold and guess what... She saw that he is working for the state of Georgia.

I then put her on hold and did a 3way call with his employer and did an employment verification check... Wow he is still employed full time... Who would have thought that I was telling the truth. Needless to say, she said they would have to "research" it and get back to me. This type of research was also done in 2000.

When he claimed he was not getting a specified amount from the military and the only reason it got fixed was because I hired an attorney and went back to court and they had to appear. The reason there are so many dead beat moms and dads out there is because this office is not doing their jobs.

We are not asking the to give us anything... I am asking them to do their job and follow the law. So beware if you think they are going to do what is in the best interest of your children. I work hard and expect their father to help take care of them... He helped make them. I refuse to get on state aid... The state didn't make my children. We did. What do you do when the law doesn't do its job.
