Breach of contract - substitution of inferior quality product for product purchased

I purchased an adjustable bed and mattress at Mancini's Sleepworld in Santa Rosa on April 7. I was told I could select a Temperpedic or a Legget & Plack bed. Leggett and Plack have been making beds for 125 years in America and their products are 100% American made. They have an excellent reputation. I came home, researched the company and went back to the store to buy a queen size Leggett and Plack.

When the bed was delivered a few days later, there was no warranty card and no product manual for either the bed or the mattress. I called the manager while the delivery truck was here and was assured it would be corrected. I reluctantly accepted the bed. 3 days later, having heard nothing, I called the store, and was told by the salesman that he would call the company and have them send me the information.

Nothing happened for 30 days. I called Mancinis this week and got the name of both manufacturers and their phone numbers. When I called I learned the bed Mancini's sold me was an Interflex, which is made in China. I don't buy from China any way, but I certainly didn't agree to buy an Interflex bed. That is a company taken over by Leggett and Plack, and the bed was made over a year ago. I called Mancini's and said I wanted a refund. The salesman said he would get back to me.

Again 3 days with no response, until I left a message that if they did not issue a refund within 24 hours I would have my bank reverse the charges. Then a sales manager from corporate called me and told me they would issue a refund on the bed, but not the mattress. Ultimately, he intimated that since they didn't type Leggett & Plack on the receipt and there was nothing in writing, I couldn't prove that is what THEY SAID THEY SOLD ME!

I believe that this company is deliberately committing fraud and did not provide a warranty card, because I would have refused the bed. He was rude and I had to hang up on him. I have now sent an email to Mr. Mancino, the President and CEO. I'll go in Monday and see if my bank can reverse the charge, other wise I'll take them to small claims and ask for punitive damages for fraud Are there any honest business people left in the world?
