I was sued by midland funding and was to appear in mediation Jan. 14 which the representing attorney rescheduled because of bad road conditions. Of course I still appeared just to cover my own rear end. So mediation was again rescheduled for Feb. 11, which he didn't show, or call to reschedule. I was informed by the mediator that day, after 1 hour of waiting for the Plaintiffs representative, that my case would be dismissed. After all final statement account was FEB. 14!!! The statute of limitations in the state of Iowa is 5 years!!! But I was again was notified the end of Feb that I would be going to trial on March 12. The attorney did show up for this one! The case was dismissed Without Prejudice on that day.
I am no lawyer, but the attorney assured me that this was simply settled because of the Statute of Limitations and because he could not produce evidence of what this debt really was. Of course that conversation was before court. This Saturday I recieved another settlement offer from Midland Funding for $2.00 less than the original. I spoke with the legal department at Midland (Barb) who informed me that she will be sending me bills until Nov. whearas she promptly hung up on me!
I am incredibly and duelly disgusted that the judge did not even ask if I knew what " Dismissed Without Prejudice " was, and the snake lawyer that represented Midland Funding. So I guess this means defendants like myself will forever be hounded... Even though I actually APPEARED 3 times and thought this nightmare was over.
